The guide covers 13 jurisdictions across the region: Australia, Cambodia, the People’s Republic of China, the Hong Kong SAR, India, Indonesia, Japan, Malaysia, the Philippines, Singapore, Thailand, Taiwan and Vietnam, and is structured in a question-and-answer format. It addresses issues of key importance to lenders in the region, including considerations when deciding whether to lend, the types of security that can be taken to protect a lender’s investment, and what happens if things go wrong. It also includes a dedicated section on working digitally, covering the electronic execution of documents, verification of witness signatures, the perfection of security without wet-ink signatures and legal restrictions on the electronic execution of financing documents.
