Biography

Dean Gerakiteys is a partner in Baker McKenzie’s Sydney office. Dean is a highly regarded intellectual property lawyer with experience across the full spectrum of intellectual property disputes, including trade marks, copyright, patents, confidential information, trade secrets and domain names.

Aside from being an expert litigator, Dean also advises clients on the protection and prosecution of their intellectual property as well as the related regulatory issues that can surround the exploitation of those assets.

Practice Focus

Dean has acted for major Australian and multinational clients at every stage of the litigation lifecycle. His track record includes successful appearances in several landmark High Court matters. While his focus is on disputes involving intellectual property his expertise extends to more general commercial disputes and regulatory disputes impacting his clients’ businesses.

In addition, Dean has an extensive non contentious IP practice, with particular expertise managing large intellectual property portfolios for globally recognised brands. He is also an expert on the intersection of branding and regulatory issues that affect brand owners in the Australian market.

Representative Legal Matters

  • Acting for a multinational healthcare and consumer goods company in relation to the prosecution and enforcement of its 25+ household brands worldwide
  • Advising one of Australia's largest suppliers of over the counter health & beauty products, on a wide variety of intellectual property and regulatory issues
  • Advising various healthcare companies on their regulatory obligations in respect of listed and registered goods and medical devices including in relation to their pharmacovigilance obligations 
  • Acting for Cantarella Bros in its highly publicised trade mark dispute against Lavazza 
  • Advising a leading supplier of catering services nationally on the prosecution and enforcement of its intellectual property
  • Advising a multinational pharmaceutical company on its Australian regulatory and pharmacovigilance obligations including the way in which it interacts with and provides information to HCPs
  • Acted on behalf of Cantarella Bros in the lead-up to, and the successful appeal in, the High Court which upheld two foreign language trademarks, (Cantarella Bros Pty Ltd v Modena Trading Pty Ltd (2014) 254 CLR 337) *
  • Acted on behalf of an PharmaCare at all stages, including in its successful defence of an appeal to the High Court on a tariff classification dispute involving international treaty obligations (Comptroller-General of Customs v Pharm-A-Care Laboratories Pty Ltd [2020] HCA 2) *
  • Acted for Pastificio Rana in its defence of trade mark infringement proceedings in the Federal Court of Australia commenced by Goodman Fielder *
  • Acted for PDP Capital, owner of the WICKED SISTER desserts brand in the Federal Court of Australia and High Court over alleged trade mark infringement, alleged contraventions of the Australian Consumer law and passing off *
  • Acted for IES Stormwater in its successful defence of ACL claims, including securing the award of indemnity costs in its favour *
  • Acted for a multinational avionics company in complex and long-standing Victorian Supreme Court proceedings involving an alleged aircraft incident. The proceedings ran for a number of years and were resolved on a confidential basis *
  • Advised one of Australia’s largest television networks on a range of broadcasting and intellectual property issues relating to the network, particularly matters relating to trademarks and copyright *
  • Advised one of the world’s largest toy companies on a broad range of intellectual property and related legal issues including sponsorship agreements with sportspersons and celebrities, the conduct of trade promotions and advertising clearance *
