Biography

Alexander Hofmann is a senior associate in the Baker McKenzie Vienna office and focuses on all matters relating to intellectual property law, unfair competition law, personality rights law, entertainment and media law as well as commercial contracting.

In frequent publications, Alexander sheds light on recent developments in his areas of expertise, with a particular focus on the world of intellectual property. Alexander also regularly holds lectures at various universities in Austria, including a course on personality rights at the Sigmund Freud University in Vienna.

Prior to joining the Firm in 2022, Alexander gained wide practical experience in litigation with a particular focus in intellectual property and IT matters in a well-known Vienna law firm and a US law firm. Alexander completed his court clerkship at the Higher Regional Court Vienna. In December 2020, Alexander passed the bar exam with distinction.

Practice Focus

Alexander’s practice is focused on advising international and domestic clients in all matters relating to intellectual property law, unfair competition law, personality rights law, entertainment and media law as well as commercial contracting.

Alexander not only advises on strategic compliance issues but with a strong track record in litigating complex cases also assists and represents clients in legal disputes on a regular basis.

Furthermore, Alexander routinely assists clients, in particular in the tech, film & television and life sciences sectors, in drafting and negotiating complex commercial agreements (such as SaaS agreements, outsourcing agreements, film production agreements, etc), ensuring that contractual frameworks align with regulatory requirements and operational needs.

He also advises international clients on digital media and technology regulation and supports the commercialization of digital assets, the allocation of IP rights in innovation partnerships, corporate transactions and the legal enablement of scalable technology solutions.

Representative Legal Matters

  • Representing a major Subscription Video on Demand (SVOD) provider in the negotiations with an Austrian collecting society of a license agreement for the use of the collecting societies repertoire on the client's service.
  • Advising a major supermarket chain in various business process outsourcing (BPO) arrangements to outsource core business processes to external BPO providers, from RFP phase to negotiating and executing of the underlying contractual agreements and assistance in subsequently managing the contractual relationship.
  • Representing Google before the CJEU in a landmark case that established for the first time that the E-Commerce Directive’s country-of-origin principle grants the EU Member State where a provider is established the exclusive authority to regulate such provider (C 376/22).
  • Advising a major international online platform on an ongoing basis on compliance issues in relation to the with the Digital Single Markets Directive and its national transposition, with a particular focus on press publisher rights (Art. 15 DSMD) and upload filters (Art. 17 DSMD).
  • Advising a large international luxury brands company in defending one of its core trade marks against an request for deletion of a competitor due to alleged non-use of the trade mark in the relevant markets.
  • Advising several large intermediary service providers in a large number of, in part high-profile, personality rights litigations (both civil and criminal) brought by claimants on the basis of allegedly illegal user content available on the client's service.
  • Advising several large international film studios and SVOD service providers in service productions in Austria on a wide range of legal matters through all stages of production. This work included reviewing and negotiating all major agreements (production services agreement, location agreements, cast & crew and equipment agreements), assisting in obtaining film permits and rights clearance and cutting through the particulars of Austrian film funding regimes (FISA+, ÖFI+).
  • Assisting an international film production company with setting up a financing and securities structure to gap finance a large FISA+-funded film project in Austria.
  • Advising an international gaming group in the course of the due diligence review of a share acquisition in another well-known gaming company with regard to IP and IT law aspects of the deal and related litigation issues.
