Jakub Falkowski
Biography
Jakub Falkowski is Senior of Counsel in Baker McKenzie's Warsaw office and co-leads the firm's Tier 1 (Legal 500 EMEA) Technology, Media and Telecommunications practice in Poland. He advises on major technology transactions and litigations across a range of industries. Jakub has been with Baker McKenzie since 2007 and completed a secondments with a global technology companies. Jakub is top-ranked for TMT by Legal 500 and Chambers. He is a member of the Association of New Technology Lawyers (SPNT).
Practice Focus
Jakub focuses on complex technology transactions and disputes. . He advises financial institutions, technology companies, media and entertainment businesses, and innovative growth companies on technology acquisitions, digital infrastructure, platform regulation, intellectual property and regulatory matters. His practice includes large-scale transformation projects, technology separation and licensing arrangements, digital media and streaming services, payments innovation, fintech products, and strategic AI and digital economy initiatives in Poland and across Europe.
Representative Legal Matters
- Advised Erste Bank Polska (formerly Santander Bank Polska) on regulatory, operational and technology-transition aspects of a EUR 7 billion cross-border banking transaction, supporting transitional arrangements and rebranding implementation.
- Advised ElectroMobility Poland on the Polish Electromobility Hub project (+1 billion EUR), including technology transfer, platform licensing, engineering, manufacturing arrangements and technology deployment for newly developed electric vehicle production.
- Advised The Walt Disney Company on media, technology and copyright matters relating to the operation and expansion the CEE region.
- Advised US-based technology company in a landmark dispute over newly established press publishers’ rights, shaping strategy in a high-profile copyright and platform regulation case.
- Advised Netflix on its CEE rollout, including dealings with collective management organizations and ongoing marketing, copyright and technology-related matters.
- Advised Hans Zimmer in a Polish media/IP dispute over unauthorized use of his protected rights in film music concerts, covering strategy, interim relief, litigation and settlement negotiations.
- Advised Visa on technology matters supporting the EMEA rollout of a new consumer payment solution.
- Advised major digital advertising companies on EMEA-wide technology, privacy and marketing matters across 25+ countries, including detailed adtech copyright and regulatory analysis.
- Successfully defended HP in four-year IT litigation mitigating potential PLN 40m recourse exposure.
- Coordinated strategic notice-and-takedown advice for a social media platform across 28 jurisdictions, covering intermediary procedures for copyright, privacy and other infringing content.
- Represented an DXC in high-stake arbitration proceedings against the largest Polish insurance company connected with the implementation of a central IT system.
- Advised a management consulting, technology services and outsourcing company on a number of IT projects in the financial, telecom and energy sectors, including the large-scale implementation in major mobile network operator in Poland.
- Advised major international VOD / streaming providers on regulatory in negotiation of licensing agreements with copyright collectives.
- Advised the central administration authority on issues related to the national road system in Poland, including issues of collecting and processing of personal data in relation to the implementation of a nationwide road traffic management system covering all motorways in the country.
- Advised a social media company and music streaming provider on copyright issues related to AI and music distribution, including licensing requirements and practice of local copyright collectives.
