
Dr. Fabienne Bretscher
Biography
Dr. Fabienne Bretscher is a seasoned associate at Baker McKenzie's Zurich office, focusing on civil, commercial, intellectual property, and competition law. She earned her PhD in dispute resolution in international human rights law from the University of Zurich and holds a master's degree in transnational law from the University of Basel.
During her graduate and postgraduate studies, Fabienne served as an associate lecturer and research assistant. She initially joined Baker McKenzie Zurich in 2018 as a trainee lawyer and returned to the Firm after being admitted to the Swiss Bar in 2021. In 2024, she spent several months at Baker McKenzie's London office.
Practice Focus
Fabienne advises both international and domestic clients on civil, commercial, intellectual property, competition, and regulatory law matters. She focuses on contentious matters and supports clients through all stages of dispute prevention, avoidance, and resolution. Additionally, she regularly assists clients with contract drafting, management, and regulatory matters.
Fabienne is an experienced counsel for parties in disputes in both state court and arbitral proceedings. She has extensive experience in supporting clients with commercial contract, trademark, design, copyright, and unfair competition disputes, as well as IT and cyber disputes.
Representative Legal Matters
- Defended an industrial engineering company in an ICC arbitration initiated by a customer in relation to a allegedly faulty plant
- Represented a US fashion company in a multijurisdictional trademark and unfair competition dispute involving both infringement and trademark cancellation proceedings.
- Advised a multinational outdoor company in a dispute with an IT supplier securing a settlement agreement.
- Defended a Swiss supplier of medical products in two SAC arbitrations against claims raised by former distributors.
- Acted for a technology provider in an SAC arbitration (including pre-arbitral dispute resolution procedure) to enforce claims for payment of service fees against a client and ultimately secured a settlement agreement.
- Advised an online auction platform in a lawsuit brought by a buyer in Swiss state courts.
- Defended a car dealer in interim injunction proceedings in the context of a contractual and trademark dispute with a car manufacturer.
- Represented a financial services provider in state court proceedings in a trademark and competition dispute ultimately resolved by an amicable settlement.
- Acted for a multinational technology company in a trademark and competition dispute with a Swiss company active in the blockchain area (including interim injunction proceedings), ultimately securing a global settlement agreement.
- Advised an international conglomerate manufacturing heavy electrical equipment and industrial machinery in drafting and negotiating a long-term contract for the maintenance of equipment sold to a Swiss company.
- Supported a multinational outdoor company on a general review of their commercial agreements (distribution agreements, sales agreements, General Terms and Conditions).
- Advised a leading Swiss electronics company in the drafting and negotiation of sale and purchase agreements.
- Supported a multinational fashion company in the drafting of template license agreements for their cooperations and regularly advises them in negotiations with commercial partners as well as contentious matters.
