Biography

Indra Bhattacharya is a partner in the Intellectual Property, Data, and Technology team at Baker McKenzie based in London. A highly experienced patent litigator, Indra represents some of the world’s leading companies in complex, high-stakes technology disputes before the UK courts. He also has extensive experience coordinating multi-jurisdictional litigation across Europe and the United States, and advising clients in arbitration, expert determination and mediation proceedings. A key part of his experience is navigating the competing strategic considerations that arise in parallel patent enforcement proceedings in Europe and proceedings before the European Patent Office (EPO).

In addition to his contentious work, Indra provides strategic counsel on non-contentious IP matters. He collaborates closely with corporate teams on commercial IP advisory and transactional work, including conducting in-depth patent and technology reviews and delivering freedom-to-operate opinions for major international deals.

Indra also advises on life sciences regulatory issues that arise throughout the product life cycle, including market access for pharmaceuticals and medical devices, borderline classification, clinical research, advertising and labelling, pricing and reimbursement and general compliance requirements affecting interactions with healthcare professionals. He has particular expertise in advising on issues that lie at the interface of intellectual property and regulation such as market exclusivity and has acted for leading pharmaceutical companies on regulatory investigations.

He has a technical scientific background and is consistently recognised in leading legal directories such as IAM Patent 1000 and the World Intellectual Property Review.   • Acting for companies in the Arxada Group in High Court patent litigation relating to paint compositions technology and successfully obtaining stay of proceedings pending EPO determination.
  • Acting for SOLiD Technologies in a multijurisdictional patent dispute concerning distributed antenna systems technology and related IP strategy on proposed roll out on London Underground and which led to the invalidation of the asserted patents.
  • Acting for one of the world’s largest pharmaceutical companies in patent litigation in the UK concerning an anti-cancer drug and coordinating pan-European enforcement action.
  • Acting for a Ferro Chemicals in trade secrets litigation before the High Court of England and Wales.
  • Advising a global leader in modular flooring technology in ICC arbitration proceedings relating to wide ranging dispute arising out of a patent a trade secret licence concerning portable flooring technology.
  • Acting for a speciality medical devices company on High Court patent infringement dispute concerning various trocar and cannula products.
  • Advising Sembcorp on patent advisory matter relating to e-compressor technology for renewable turbines.
  • Acting for IATA in a patent opposition before the European Patent Office relating to a patent concerning automated authentication systems.
