Biography

Indra Bhattacharya is a partner in Baker McKenzie's Intellectual Property, Data and Technology Practice Group in London. He advises leading pharmaceutical, biotechnology, technology and industrial companies on high-value patent, trade secret and innovation-related matters, combining contentious, transactional and regulatory expertise to help clients protect, commercialise and defend their most valuable technologies.

Practice Focus

Indra is an experienced patent litigator who regularly handles complex patent disputes before the UK courts and coordinates multi-jurisdictional litigation and enforcement strategies across Europe and the United States. He also has substantial experience advising on trade secret disputes, confidential information and know-how protection, patent licensing and royalty disputes, as well as arbitration, expert determination and mediation proceedings.

Beyond disputes, Indra is a trusted strategic adviser on patent licensing, freedom-to-operate, IP-driven transactions, technology transfers, collaborations and portfolio strategy. He regularly works alongside corporate and commercial teams on complex acquisitions and licensing arrangements where patents, know-how, data and regulatory rights are central to deal value.

A significant focus of his practice is the life sciences sector, where he advises innovative pharmaceutical, biotechnology and medical technology companies on patent and trade secret strategy, regulatory exclusivities, market access, product lifecycle management and disputes at the interface between intellectual property and regulation. He is particularly recognised for helping clients navigate the increasingly complex overlap between patents, trade secrets and regulatory frameworks in highly regulated industries as well as in the deployment of AI for healthcare companies.

Drawing on a scientific background, Indra combines technical expertise with commercial judgement and is regularly engaged on business-critical mandates involving cutting-edge technologies. He is recognised in leading legal directories including IAM Patent 1000 and IP STARS, and is a frequent speaker and author on patents, trade secrets, life sciences innovation and artificial intelligence. He has lectured on intellectual property law at the University of Cambridge and regularly presents at industry conferences and client events.

  • Acting for GSK in a patent royalty dispute concerning blockbuster oncology products, involving complex issues of patent claim scope, contractual interpretation, regulatory exclusivities and royalty entitlement.
  • Advising SLB (previously Schlumberger) on a cross-border patent ownership and inventor compensation dispute relating to patented oilfield technologies, involving complex issues of inventorship, assignment and employee remuneration rights.
  • Advising American Express on the development and implementation of a global trade secret protection strategy, including the design of governance measures and employee safeguards across multiple jurisdictions.
  • Advising Lonza on the acquisition of the GeminiMab™ bioconjugation technology platform, including associated patent rights, know-how, licensing arrangements and future technology development rights.
  • Acting for companies in the Arxada Group in High Court patent litigation relating to paint compositions technology and successfully obtaining stay of proceedings pending EPO determination.
  • Acting for SOLiD Technologies in a multijurisdictional patent dispute concerning distributed antenna systems technology and related IP strategy on proposed roll out on London Underground and which led to the invalidation of the asserted patents.
  • Acting for Celegene in patent litigation in the UK concerning an anti-cancer drug and coordinating pan-European enforcement action.
  • Acting for a Ferro Chemicals in trade secrets litigation before the High Court of England and Wales.
  • Advising a global leader in modular flooring technology in ICC arbitration proceedings relating to wide ranging dispute arising out of a patent a trade secret licence concerning portable flooring technology.
  • Acting for a speciality medical devices company on High Court patent infringement dispute concerning various trocar and cannula products.
