Myroslava Koval-Lavok
Biography
Myroslava Koval-Lavok is a counsel in Baker McKenzie’s Intellectual Property Practice Group in Kyiv. Myroslava is a registered patent and trademark attorney in Ukraine and a member of the attestation commission of the Ukrainian National Office for Intellectual Property and Innovation. On top of her professional activity, Myroslava is also a guest lecturer at Ukrainian universities, focusing on providing a practical view on IP protection in Ukraine and abroad.
Practice Focus
Myroslava specializes in IP law, including comprehensive advice on IP enforcement and anti-counterfeiting, IP clearance, IP portfolio management, trademark and patent registration, structuring of sophisticated IP/IT transactions, licensing, and franchising.
She particularly focuses on providing strategic advice on IP rights (IPR) protection, patent and trademark searches, global portfolio management, IP-related transactions, structuring and supporting license and/or franchise deals, IPR protection at customs, IP due diligence and alternative conflict resolution (ACR) for matters involving IPR infringement.
Myroslava acts as a strong negotiator at all stages of ACR and IP/IT transactions.
As a registered patent and trademark attorney of Ukraine, Myroslava represents clients before the UAIPO, customs bodies, police and other state bodies and private entities in matters relating to IPR protection and enforcement.
Representative Legal Matters
- Advised a British multinational alcoholic beverage company on all aspects of trademark protection in Ukraine, including preparing and executing complex trademark filing strategies, which mostly involved monitoring and combating conflicting trademark applications, and preparing and filing oppositions, communications and negotiations with infringers, thus protecting the client’s valued trademarks from direct infringement and possible dilution.
- Represented an American clothing company before the Ukrainian customs authority in relation to the protection of trademark rights and counterfeit products distributed in Ukraine.
- Advised an Irish company, which provides services related to the lease of intellectual property products, on all aspects of trademark protection in Ukraine, including preparing and executing complex trademark filing strategies, which mostly involved monitoring and combating conflicting trademark applications, and preparing and filing oppositions, communications and negotiations with infringers.
- Represented a multinational company selling cosmetics and personal care products in a potential conflict regarding use of similar trademarks of some media company, which included working on a strategy to solve the conflict and assisting in the execution of the same strategy, including possible rebranding and protection of new trademarks.
- Advised a pharmaceutical company on handling the prosecution of a group of invention applications in the field of pharmaceutical preparations in Ukraine.
- Advised an American luxury hotel and casino on all aspects of trademark protection in Ukraine, including preparing and executing complex trademark filing strategies, responding to provisional refusals issued in relation to pending applications filed in or designated in Ukraine, monitoring infringing trademark applications and registrations, filing oppositions against such infringing trademark applications and registrations, and performing clearance searches.
- Represented a British oil and gas company before the Ukrainian customs authority in matters related to the registration of the client’s trademarks, including assisting the client with corresponding work, including ceasing the customs clearance of counterfeit goods and overseeing the destruction of such ceased counterfeit goods.
- Advised an international entertainment company on all aspects of trademark protection in Ukraine, including preparing and executing complex trademark filing strategies, managing the client’s global portfolio, renewing its trademark rights, designing and executing complex internal and external trademark transactions, and recording them before the UAIPO.
- Represented an international pharmaceutical company in several online enforcement matters in Ukraine and helped the client preserve the reputation of its well-known brand in Ukraine, including advising the client in relation to the UDRP action to be filed within the .com.ua domain name zone.
- Represented one of the largest snack companies in all aspects of trademark protection in Ukraine, including preparing and executing complex trademark filing strategies, responding to provisional refusals issued in relation to pending applications filed in Ukraine, monitoring infringing trademark applications and registrations, filing oppositions against such infringing trademark applications and registrations, and performing clearance searches.
- Represented a leading multi-category consumer goods company in all aspects of trademark prosecution in Ukraine, focusing on trademark searches, renewals, filing new trademark applications, office actions and filing oppositions.
- Advised an American specialty retail company on gaps in their trademark protection in Ukraine, including preparing and executing complex trademark filing strategies, responding to provisional refusals issued in relation to the client’s applications filed in or designated in Ukraine, monitoring infringing trademark applications and registrations, filing oppositions against such infringing trademark applications and registrations, and filing domain name complaints with the WIPO Arbitration and Mediation Center using the Uniform Domain Dispute Resolution Administrative Procedure.
