Biography

Rakhee Dullabh is a senior associate in Baker McKenzie's Melbourne office in the Intellectual Property and Technology practice. She joined the Firm in 2022 and was previously a partner at the largest law firm in Johannesburg, South Africa in the TMT practice. She has experience in outsourcing and complex technology transactions and advising clients on data privacy compliance.

Practice Focus

Rakhee's practice focuses on IT transactions, drafting and negotiating commercial and IT-related agreements including those relating to outsourcing, ICT procurement, software, hardware, systems integration, consultancy, cloud computing and IT policies and procedures.

Rakhee also assists clients with cybersecurity, electronic communications, advertising, and compliance with IT law.

Her data privacy experience includes advising clients on their compliance with data privacy laws, conducting gap analysis of data processing activities, drafting data processing agreements and conducting training and workshops for clients on these issues.

Key industry sectors in which Rakhee works are TMT, financial services, consumer goods and retail, mining and public sector.

Representative Legal Matters

Prior to joining Baker McKenzie, Rakhee advised on the following matters:

  • Advised an emerging digital bank in South Africa with the establishment of a bank, particularly in respect of its key technology services contracts.

  • Assisted a major South African financial institution with the contracting and negotiation of its key IT outsource service providers.

  • Assisted a major South African financial institution with the drafting and negotiation of the single largest outsourcing transaction in its history.

  • Advised a major South African mobile network operator with its overall data privacy strategy and compliance framework.

  • Assisted a prominent social media provider in respect of responding to requests of information and allegations of non-compliance with data privacy laws in South Africa. This included providing strategic data privacy advice and preparing responses to the regulator.

  • Represented a subsidiary of a South African mining company to ring-fence the development, implementation, and maintenance of its bespoke IT technology.

  • Advised a large, multi-national with the re-negotiation of its core ICT services.

  • Advised various South African clients with their data privacy compliance, which included understanding and mapping their data processing activities, implementing compliance frameworks, drafting policies, drafting and negotiating agreements with third parties and generally advising on their compliance with local laws.
