Biography

Simone Rieken is a partner in Baker McKenzie's Frankfurt office and a member of the Information Technology Practice Group. Simone advises on all aspects of IT, data (including data protection), AI and other digital laws. Prior to joining the Firm, she worked for a large German corporate law firm, also focusing on IT and data protection law. She was seconded to a major management consulting, technology and outsourcing services provider to work on IT contracting.

Practice Focus

Simone focuses her practice on IT outsourcing and IT transactions, including IT-related tenders at the interface with public procurement law. Another focus of her practice is on the analysis of IT, AI and data driven business models for compliance with new AI, data and tech related laws and regulations.

Representative Legal Matters

  • Advised a car manufacturer throughout all phases of a high-volume global IT outsourcing project, including establishing the complex contractual framework, provider selection, and negotiation phase.
  • Advised a software provider on the terms of use for a new AI chat-bot enabled product.
  • Advised a pharmaceutical company on the obligations under the EU AI Act and the respectively required scoping and compliance steps.
  • Advised companies from various industries on the application of the EU Data Act to their products and (cloud) services and the adaptation of their offerings and contract templates with respect to the new requirements.
  • Advised a car manufacturer in a complex project including a new service offering with respect to IT and data protection compliance and the contractual framework with cooperation partners, suppliers and customers.
  • Advised an IT services provider on the negotiation and conclusion of a strategically important pilot contract in the public sector.
  • Advised cloud and IT services providers on contract conclusions in connection with public tenders and application of the EVB IT.
  • Advised a cloud provider on complex data protection law issues when providing cloud services in regulated industries.
  • Advised a software provider on the conclusion of a strategically important outsourcing agreement with a German asset manager.
  • Advised the prime contractor of a telecommunication services provider in a landmark project involving new technology.
  • Advised a wholesale company on the group-internal restructuring of IT services and the conclusion of a complex outsourcing agreement with a strategic partner.
  • Advised a company on a complex intra-group contractual framework for the procurement of IT services.
  • Advised organizations on the implementation of a data management platform and use cases involving comprehensive website tracking and profiling from a data protection law perspective.
  • Advised various companies with respect to direct marketing campaigns and customer loyalty programs pursuant to data protection law and unfair competition law, including the drafting of related consents.
  • Advised various companies with regard to mobile applications and online shops pursuant to data protection law and e-commerce law.
  • Advised in connection with numerous M&A transactions from an IT and data protection law perspective during the due diligence and SPA phase, including the conclusion of TSAs.
