Biography

Sebastian Busa is a partner in the Sydney office. Sebastian is a recommended real estate practitioner by Asia Pacific Legal500. He is also a Green Star Accredited Professional. This accreditation allows him to provide specialist property advice to clients on green lease provisions, agreement for leases, fitout arrangements and other development agreements where there is a green building and environmental issue. While working in the Firm’s London and Manila offices, Sebastian gained valuable offshore experience in the area of real estate and trust law.

Practice Focus

Sebastian advises on structured property transactions and on the acquisition, development and sale of hotels and resorts, bifurcated property and business structures, industrial, commercial and mixed use developments. As a seasoned adviser on property development, Sebastian is highly experienced in complex title structuring, purpose built facilities, agreement for leases, development agreements, joint venture agreements and associated trust and taxation structuring. Sebastian also has a large commercial leasing practice and specialises in purpose built facilities under agreement for leases and tax effective lease incentive arrangements. His clients include major property developers, major corporate tenants, institutional investors, hotels and resorts, and REITs industry participants.

Representative Legal Matters

  • Advised OneSteel in relation to its property portfolio including disposals and sale and leaseback arrangements, land swaps, and on the redevelopment of strategic land, easements and compulsory acquisitions.

  • Represented ALDI in respect of the acquisition on numerous sites for retail and warehouse use development including the development of stores in mixed use developments.

  • Advised Louis Dreyfus on the development of a major grain handling and rail distribution facility including advising on complex title and planning issues and rail access arrangements.

  • Counseled Medina Property Services on the development of new hotel apartment sites at Randwick Race Course and Norwest Business Park.

  • Represented Host as consortium member of the under-bidder of the redevelopment of the Sydney Convention Centre Precinct.

  • Represented LaSalle Investment Management on the acquisition of Australia on Collins retail complex and Sofitel Sydney Wentworth including trust structuring and bifurcation ownership structures.

  • Acted for TCC International, a Thai conglomerate, on the purchase of the Novotel Rockford, Sydney, Hyatt Canberra and Hyatt Adelaide.

  • Represented Pacifica Partners, joint venture arrangement between GIC and Host Hotels on the acquisition of Melbourne Hilton South Wharf.

  • Advised on the disposition of Lilianfels, Stamford Double Bay and The Observatory and acquisition of Metro Central, Marriott Parramatta and Gladestone Hotel for various clients.

  • Represented Lion Nathan on its high profile acquisition and development of Pumpkin Island as XXXX Island.
