In brief
On September 11, 2026, Treasury and the IRS released proposed regulations on Information Reporting Regarding Qualified Opportunity Zones (QOZs) and Updated Qualified Opportunity Fund Certification and Decertification Procedures1 (“Proposed Regulations”). The Proposed Regulations implement the QOZ information reporting regime that was enacted by the One Big Beautiful Bill Act (OBBBA). Comments are due by October 16, 2026.
The Proposed Regulations would require (i) qualified opportunity funds (QOFs) to file comprehensive annual information returns, (ii) qualified opportunity zone businesses (QOZBs) to furnish annual information statements and compliance attestations to QOFs, and (iii) investor-level reporting for disposition events.
