Biography

Brendan O'Grady is a senior associate with Baker McKenzie's North America Litigation & Government Enforcement Practice Group in Toronto. He advises on commercial litigation and arbitration proceedings.

Practice Focus

Brendan's litigation practice has covered a wide range of corporate commercial matters involving fraud, negligence, misrepresentation and economic tort actions, as well as numerous technical contractual disputes.

Brendan has represented defendants and plaintiffs in multi-jurisdictional class proceedings involving allegations of price-fixing and bid-rigging, securities misrepresentations, privacy breaches, product liability, employment standards and consumer protection.

Brendan has acted in major domestic and international arbitration under the BCICAC and UNCITRAL rules of procedure.

Brendan frequently works with Baker McKenzie's global team in international fraud, asset recovery, enforcement of foreign judgment and letters rogatory proceedings. Brendan has also acted in several jurisdiction disputes.

Brendan has worked closely with clients from multiple industrial sectors spanning transportation, infrastructure, mining, chemicals, aerospace, automotive, food products, banking/finance and technology.

Representative Legal Matters

  • Represented a multinational engineering firm in numerous venues facing allegations of negligence and claims for damages of nearly USD $600 million.

  • Acted in class proceedings against a Canadian telecommunications company for allegedly improper use of customer metadata.

  • Represented a Japanese electrical components manufacturer in multi-jurisdictional class proceedings involving alleged price-fixing.

  • Represented a US social media company to protect the anonymity of its users.

  • Represented a Swiss medical device manufacturer in a jurisdiction dispute.

  • Represented an international bank in a letter of credit dispute.

  • Represented a US railway in major domestic commercial arbitration (BCICAC) concerning disputed tariff obligations.

  • Represented a foreign state-owned mining company in major international commercial arbitration (UNCITRAL) at the Hague Permanent Court of Arbitration.

  • Advised London-based counsel in one of the UK's first ever class proceedings. This ground-breaking case before the Competition Appeal Tribunal concerned allegations of bid rigging.
