Biography

Huyen-Minh is a special counsel of the Intellectual Property and Technology practice in Vietnam. She possesses in-depth expertise in advising both foreign and local companies on navigating the evolving and divergent local laws on Data Privacy, E-Commerce, Fintech & Insurtech, Telecommunications, Online Gaming, and Digital Media & Content. She is also an active policy advocate in the data protection, cybersecurity, and technology areas, with worldview and cultural nuances informing her policy lens.

Huyen-Minh’s clients span diverse industries, including banking and finance, payment services, insurance, technology, foods and beverages, production, and retail.

Representative Legal Matters

Data Privacy

  • Advised a global technology company in the payments industry on bringing several of their payment products into compliance with Vietnamese data privacy laws (i.e., Decree No. 13/2023/ND-CP on Personal Data Protection).
  • Advised a Canadian insurance company on various issues on data privacy, including legal review of Terms for Personal Data Processing, advice on data privacy regulations.
  • Conducted a thorough audit of data processing practices of a renowned multinational beverages manufacturer to ensure compliance with relevant data privacy regulations and industry standards, while also identifying opportunities to enhance data security and consumer trust.

E-Commerce

  • Assisted a leading social media company on the launch of an in-app function enabling users to set up shops and offer goods in their account on the platform.
  • Assisted a Chinese e-commerce platform on dealing with public backlash due to early launch without proper license in Vietnam.
  • Advised an American experience and accommodation platform on complying with Vietnamese e-commerce regulations and requests from local regulator.

Fintech & Insurtech

  • Advised the subsidiary of a Chinese fin-tech company on market entry into Vietnam with respect to providing credit analysis and P2P lending services.
  • Advised a Taiwanese insurance company on various legal issues in relation to its digitalization process, among others, data privacy, restrictions on cross-border provisions on insurance services, requirements for separation of life insurance and non-life insurance business operations; data storage via cloud; etc.
  • Advised a French insurance company in relation to data privacy issues in relation to its insurance broker portal.

Telecommunications

  • Advised a Vietnamese mobile network operator on the legality of their plan to imitate carrier billing for gaming services in Vietnam, including an analysis of current telecoms law.
  • Advised a Chinese internet company on compliance plans for its OTT communications service and cloud computing service in Vietnam in response to the new Law on Telecommunications.
  • Assisted a Vietnamese French television joint venture in requesting local regulator to return the license for establishment of telecommunications network.

Digital Media & Content

  • Advised an international audio streaming and media services provider on a full spectrum of technology and media services, such as the provision of media services and plan to launch an interactive audio chat feature on their platform.
  • Assisted an American content streaming service in obtaining a Certificate of Eligibility of Self-Classification for Online Films from the Cinema Department.
  • Assisted an American gaming publisher in avoiding getting its popular gaming app taken down from app stores due to not having proper gaming license and preparing a comprehensive compliance plan.
