Donna McComber is a director of economics for Baker McKenzie Consulting LLC in Washington, DC. She is a seasoned transfer pricing advisor with deep technical insight into complex transfer pricing issues. Prior to rejoining Baker McKenzie, Donna was Assistant Director of the Advance Pricing and Mutual Agreement Program (APMA) under the US Internal Revenue Service's Large Business & International Division. She managed teams that were responsible for cases in the following countries: Argentina, Caribbean countries, China, Denmark, Eastern European countries, Germany, India, Ireland, Israel, Mexico, Portugal, Norway, Spain, Sweden, Switzerland, UK, and Venezuela. During her time at APMA she was part of the team that negotiated the US-Mexico agreement on transfer pricing and other aspects of the tax treatment of maquiladoras of US multinational enterprises.

Prior to becoming Assistant Director, Donna was the Deputy Director (technical) where she focused on quality control measures and engaged in evaluating proposed settlements for all significant APA and MAP cases. She also negotiated APA and MAP cases with treaty partners including Australia, Canada, China, Denmark, Germany, Japan, Mexico, Korea, Switzerland, and the UK.

While at APMA, Donna also was a drafter and reviewer of the US temporary and final cost sharing regulations

Practice Focus

Ms. McComber focuses her practice on transfer pricing, negotiating and consummating advance pricing agreements for US and foreign-based multinationals. She advises on matters involving examination, appeals, advance pricing agreements and competent authority matters. This work has given her experience with highly complex issues, including intangibles migration, restructuring, and financial product cases.
