Marlies Kittinger
Biography
Prior to joining the Firm in May 2023, Marlies Kittinger gained professional experience as a legal trainee at the European Union Intellectual Property Office in Spain, as a law clerk at the Vienna Higher Regional Court and as a paralegal at a boutique law firm in Innsbruck. She studied Management & Law at the Management Center Innsbruck (MCI) and Law at the University of Innsbruck and the Stellenbosch University in South Africa.
Practice Focus
Marlies’s practice is focused on advising clients in regulatory and civil technology litigations in the areas of IP, data protection, AI and digital business models. Additionally, Marlies advises multinational and domestic clients in all matters relating to data protection, technology law, intellectual property and commercial contracting.

- Advising a credit agency in administrative proceedings before the Austrian Data Protection Authority and civil proceedings in various Austrian civil courts relating to alleged infringements of data subject rights.
- Advising an energy supplier in administrative before the Austrian Data Protection Authority a relating to alleged infringements of data subject rights.
- Representing a software company in various civil proceedings before Austrian civil courts in connection with an alleged violation of gambling law by loot boxes.
- Advising the shareholders of APEIRON Biologics AG on the sale of their shares to an American investor.
- Advising the Kudelski Group, a world leader in digital security solutions, on the sale of SKIDATA to ASSA ABLOY, a global security solutions partner.
- Advising Lindsay Corporation on the acquisition of a minority interest in Austria-based Pessl Instruments GmbH.
- Advising an energy supplier in mass litigations against 180 customers, including before the Austrian Supreme Court.
- Advising the European franchisee of a major franchise system on contract negotiations with its franchisor.
- Advising a major media production company on a movie production.
