Biography

Van Trung Khuat joined Baker McKenzie in Ho Chi Minh City in April 2012, and is experienced in areas of employment, dispute resolution, and corporate compliance and investigation. He is an accredited mediator at the Center for Effective Dispute Resolution (CEDR) in London and at the Vietnam International Commercial Mediation Center, and frequently publishes articles and leads seminars on both advisory and contentious labor and employment law issues in Vietnam.

During his time with Baker McKenzie, Trung has also worked in the Firm's Hanoi and Chicago offices. He also acts as Co-chair of the Human Resources and Training Committee of the European Chamber of Commerce in Vietnam.

Practice Focus

Trung’s practice focuses on labor and employment, dispute resolution, corporate compliance and investigation. In addition, his practice also covers various areas of the law affecting the day-to-day operations of business entities, including corporate services and commercial transactions.

Representative Legal Matters

  • Assisted various multinational clients in relation to commercial disputes, which involved providing strategic advice, negotiating for settlement, mediating and participating in court and/or arbitration proceedings.

  • Advised on various employment and labor issues such as regulatory advice, termination, employment due diligence, global mobility, restrictive covenants and trade secrets, reorganization and redundancy, and employment aspects upon mergers and acquisitions.

  • Acted in various employment termination cases, which involved providing strategic advice, contract preparation and negotiations with employees.

  • Assisted various multinational clients in relation to employment disputes, which involved providing strategic advice, negotiating for settlement, mediating and participating in court proceedings.

  • Successfully represented various clients in legal issues arising from the liquidation/closure of their business in Vietnam, which included termination of employment, employment and commercial disputes, tax, immigration, and commercial issues.

  • Participated in various HR workplace behavior and compliance investigations, which involved providing preliminary assessment for the investigations, conducting document review and employee interviews, and project management.

  • Worked on various advice covering a wide range of legal issues arising in several major MNCs’ day-to-day operations and business such as workforce management, marketing and distribution, and product liability.

  • Previously seconded to a major German automobile company to serve as general counsel.

  • Advised a major client in relation to various telecom matters, such as the establishment of telecom infrastructures, turnkey contracts for constructing BTS projects in Vietnam, business cooperation contracts for establishing telecom networks in Vietnam, and fiber optics cable construction projects.

  • Advised a major Vietnamese corporation on preparing its licensing application for a wind farm project in Vietnam.
