Biography

Kimberley Fischer is a member of the international trade practice in Baker McKenzie's Berlin office. She joined the Firm in 2022. Kimberley studied law at the Ruprecht Karls University of Heidelberg and the Universidad de Deusto (Spain), specializing in public international law and human rights. Prior to joining Baker McKenzie, Kimberley completed her legal traineeship at the Higher Regional Court of Frankfurt am Main, the German Federal Foreign Office in Berlin and at an international law firm in Brussels and Frankfurt am Main. She also gained significant experience in public (international) law as a research assistant at the University of Heidelberg and at a reputable law firm.

Practice Focus

Kimberley focuses on international, European and public law governing international trade compliance and sustainability. She advises clients on internal compliance systems, sanctions and embargo regimes, export control law and foreign investment reviews. She accompanies internal and external investigations and self-disclosures of export control and sanctions breaches. In addition, she assists clients in complying with the rapidly evolving EU and German legal landscape on sustainability, in particular the new directives and regulations under the EU Green Deal and the German Supply Chain Due Diligence Act. This includes setting up and improving corporate governance structures and internal compliance programs with regard to environmental, social and governance (ESG) matters.

Representative Legal Matters

  • Conducting an internal investigation into suspected export control and sanctions violations for a global sanitary products manufacturer and assisting the client in improving its internal trade compliance structures.
  • Assisting several clients in the pharmaceutical industry in complying with EU and German export control and sanctions regulations and conducting internal audits to identify opportunities for improvement in the internal compliance system.
  • Assisting a consulting firm with the integration of an internal compliance system.
  • Advising numerous companies on the restrictions of the UN and EU Russia sanctions regime.
  • Advising several companies on a variety of export control issues, in particular the need for/application for export licenses, the Dual-Use Regulation and German regulatory practices.
  • Advising a US energy technology company on its sustainability strategy and on ongoing sanctions and customs compliance matters.
  • Advising a US software company on the German Act on Corporate Due Diligence in Supply Chains and ESG law developments at the EU level.
  • Advising a global automotive supplier on the implementation of global ESG standards and reporting requirements.
  • Advising an international video game company on German and European foreign direct investment regulations.
  • Representing numerous entities in foreign investment review proceedings before the German Ministry of Economic Affairs and Climate Protection.
