Biography
Amy Wellington is a senior associate in Baker McKenzie's Dispute Resolution Practice Group in Melbourne.
Practice Focus
Amy advises clients in relation to competition and consumer, commercial, contractual, regulatory and administrative law disputes across a variety of industries. Her clients include Australian and multinational companies, individuals, and government agencies.
Amy has experience in conducting and managing various interlocutory aspects of large commercial litigation and class actions.
Representative Legal Matters
- Acting for the representative applicants in consumer class actions in the Federal Court of Australia, including:
- against the issuer of extended warranty products involving complex contractual interpretation of the warranties and allegations of unconscionable conduct and unfair contract terms
- against a supplier of allegedly defective water pipes used in properties in Australia
- in a class action in against Medibank arising out of the 2022 data breach
- Advising the ACCC on various disputes regarding alleged misleading and deceptive conduct and unconscionable conduct in the travel, healthcare and agriculture industries.
- Advising multinational companies on compliance with Australian competition and consumer law.
- Advising multinational companies on their approach to responses to regulators' exercise of compulsory information-gathering powers.
- Advising a multinational company on its compliance with a mandatory recall process.
- Advising companies on regulatory investigations and enforcement proceedings involving various state and federal regulatory bodies and advising on engagement with regulators in relation to a range of competition, consumer law and corporate governance issues.
- Acting for a former CEO of an ASX-listed company, who was summonsed to give evidence by the IBAC in relation to an ongoing investigation into alleged serious corruption at the Victorian Department of Education and Training.
- Advising VicForests on various disputes including Supreme Court of Victoria and Federal Court of Australia proceedings concerning the construction and interpretation of legislative and subordinate instruments relating to timber harvesting in Victoria and management of endangered flora and fauna in State forests.
