Biography

Roger van de Berg, a partner in the Amsterdam office's Indirect Tax group and specializes in VAT and other indirect taxes. He is also a member of Baker McKenzie's EMEA VAT Steering committee.

Roger has a strong focus and 10+ years of experience on crypto and blockchain technology, assisting exchanges, miners, funds and marketplaces on EU VAT implications and audit readiness. He also assists various tech and retail companies on VAT implications of moving into metaverse(s) and NFTs.

His work further includes advising on European and Dutch VAT aspects of cross-border transactions, M&A, supply chain restructuring, fiscal representation matters, holding companies and compliance issues.

Roger regularly speaks at conferences on VAT, due diligence and bitcoin/blockchain technology. He also wrote on the EU VAT treatment of bitcoins in the Weekblad Fiscaal Recht (Weekly Tax Law) as well as a formal recommendation to the OECD with respect to the taxation of cryptocurrencies in Europe.

Practice Focus

Roger has been involved in several multi-country M&A and restructuring projects between leading companies in tech and retail. He also assisted in major Dutch VAT disclosure and qualification projects for high-tech product manufacturers and crypto platforms. He has extensive experience working with non-EU based companies who use the Netherlands as their point of entry into Europe and assists these companies with expansion to other EU Member States.
