Tomas Tuszynski
Biography
Tomas Tuszynski is an associate in Baker McKenzie's Los Angeles office and a member of the Dispute Resolution Practice Group.
Prior to joining Baker McKenzie, Tomas practiced insurance coverage litigation for specialty insurance markets at another law firm. In this role, he supported litigation efforts and provided legal counseling for complex insurance coverage, bad faith, allocation, reimbursement, and other disputes on behalf of domestic and international insurers across multiple lines of coverage. Tomas externed with Judge F. Aenlle-Rocha at the US District Court for the Central District of California in 2023. Prior to his time at UCLA Law School, Tomas also worked as a paralegal and office support staff to multiple boutique litigation practices and supported judges and attorneys alike in legal internships in various fields throughout Southern California.
Practice Focus
Tomas's practice focuses on achieving client-driven results in all manner of business disputes for domestic and international clients, including through state and federal litigation, domestic and international arbitration, and government enforcement actions, among others. He represents retail, securities, construction, technology, and other businesses across a broad spectrum of industries, with a particular emphasis on contractual, employment, securities, financial, and trade disputes.
Tomas ensures success in litigation by focusing on his clients' needs and expectations, focusing on achieving his clients' goals according to the specific facts of each case and his clients' business needs.
Representative Legal Matters
- Litigated a dispute between an international insurer and an NCAA Division I football player regarding a coverage dispute and allegations of bad faith after the athlete suffered an allegedly disabling injury
- Litigated an insurance coverage dispute relating to more than USD 50 million in losses resulting from the seizure of an American oil tanker by the Iranian Navy in the Straight of Hormuz
- Litigated a claim of fraud, bad faith, and breach of contract relating to a domestic insurer's appraisal of homes in Pacific Palisades, CA and losses resulting from the Palisades wildfire
- Advised international insurers on allocation of coverage and reimbursement rights relating to hundreds of millions of dollars in defense expenses for seven of the ten largest homebuilders in the US
- Litigated a dispute between a domestic excess insurer and a large property development corporation relating to defense expenses exceeding USD 10 million imposed as a result of an executive's involvement in a DUI resulting in a deadly car accident
- Litigated an insurance coverage dispute relating to sexual assault allegations at a Catholic Archdiocese
- Litigated an insurance coverage dispute in excess of USD 40 million arising from the failed purchase and sale of a corporate headquarters complex
- Advised major global airlines on insurance coverage issues relating to COVID-19 cancellations of service
