Tomas Tuszynski

Tomas focuses his practice on complex business disputes in state and federal courts, domestic and international arbitration, government enforcement proceedings and internal investigations. He represents companies in securities, consumer, technology, employment, contractual, financial and trade disputes, among others. His experience includes defending large class actions and mass-arbitration campaigns; litigating claims involving alleged securities fraud, data breaches and unfair business practices; conducting sensitive workplace and corporate investigations; and advising businesses regarding emerging regulatory and litigation risks.

Tomas approaches each matter with a focus on the client’s practical and commercial objectives. He works with clients to develop strategies tailored to the governing law, procedural posture, factual record and broader business considerations affecting the dispute.

• Defended an international energy infrastructure company and several of its corporate executives in federal securities litigation involving alleged misstatements, financial reporting issues and investor losses, including briefing motions for summary judgment resulting in an early favorable resolution.
• Brought federal securities claims on behalf of an aerospace and defense company and related parties against the perpetrators of an alleged short-and-distort campaign, including securities manipulation, defamation, fraudulent advertising, and related business tort theories.
• Represented a global consumer-electronics company in coordinated class actions and a large-scale mass-arbitration campaign concerning the announced discontinuation of cloud and application support for smart-home products, including pre-arbitration demands, dispositive and venue motions, claimant analysis, mediation and revisions to consumer dispute-resolution provisions. 
• Assisted with a cross-border internal investigation for a global consumer-products company concerning corporate governance, employee compensation practices, and breach of fiduciary duties.
• Conducted a sensitive internal compensation and employment workplace investigation for the US affiliate of a global financial-services organization.
• Defended a payment-technology company in consolidated federal data-breach class litigation.
• Represented a judgment creditor in California enforcement proceedings involving interests in real property and a limited partnership, including disputes concerning allegedly void transfers, charging orders, foreclosure remedies, appellate proceedings and competing creditor rights.
• Represented an international food-products supplier in a US International Trade Commission investigation involving claims relating to improper product labelling and import regulations.
• Represented an international nuclear fuel storage contractor in a contractual dispute arising from services provided in connection with decommissioning of a major nuclear power plant.
• Advised a major global restaurant franchisor regarding franchisor responsibility for evolving legislation and associated regulatory fees.
• Litigated a dispute between an international insurer and an NCAA Division I football player regarding a coverage dispute and allegations of bad faith after the athlete suffered an allegedly disabling injury.
• Litigated an insurance coverage dispute relating to more than USD 50 million in losses resulting from the seizure of an American oil tanker by the Iranian Navy in the Strait of Hormuz.
• Litigated claims of fraud, bad faith and breach of contract relating to a domestic insurer’s appraisal of homes in Pacific Palisades, California, and losses resulting from the Palisades wildfire.
