Abe Sun
Biography
Abe Sun is a partner in our IP and Technology Practice Group. He is the head of our Patents Practices for Thailand and Singapore, and he leads our Patents Business Unit for the Asia Pacific region. His main areas of practice include IP and technology advisory, with a strong focus on highly complex and cutting-edge technologies. With over sixteen years of extensive and international legal experience as a lawyer and over ten years of technical experience as an engineer in the US and Canada, Abe is able to provide commercially oriented legal and technology-specific advice on a wide range of legal issues.
Practice Focus
Abe provides substantive legal and technology-specific advice on a variety of highly complex technology issues.
On the patents side, Abe advises on the entire lifecycle of patents, including patent prosecution, validity, infringement, FTO, and due diligence. Abe regularly drafts patent specifications, provides various legal opinions, and prosecutes patent applications in various jurisdictions, including the US, Thailand, Singapore, and other countries. He also provides strategic, tailored, and practical advice on how and where to best pursue IP protection. In terms of contentious matters, Abe has an impeccable record in patent, trade secret, and copyright infringement cases.
On the technology side, Abe advises clients on a variety of complex issues, including JVs involving valuable proprietary technologies, acquisitions/licensing of registered and unregistered IP and technologies, and advice on substantive issues relevant to the value and soundness of IP portfolios as a key asset class of any company.
Abe advises clients on a variety of technologies, including those pertaining to computer hardware/software, business methods, fintech, sustainable technologies, AI, DLT/blockchain, cryptocurrencies, bio-medical technologies (including bio-medical devices and surgical robotics), telecom, semiconductor devices and fabrication, data storage technologies, optics, stereoscopic and autostereoscopic technologies, robotics, aerospace, transportation, oil and gas, regenerative/clean energy technologies, etc.
Representative Legal Matters
Patent prosecution and strategies
- Draft patent specifications, provide strategic patent and technology advice, provide strategic advice on filing and pursuing protection of innovations, perform substantive patent prosecution, and manage global patent portfolio various local and international companies.
- Advise on substantive patent, trade secret, and other IP matters, including performing multi-jurisdictional IP landscape analyses, freedom to operate (FTO), patentability analyses, validity analyses, infringement analyses, and IP valuation.
- Advise on creating internal IP policies, guidelines, references, and playbooks so as to, among other things, ensure uniformity of IP policies and practices globally; improve IP knowledge and literacy among legal, technical, and management teams; and alleviate the burden of the legal team from having to respond to all internal IP inquiries and requests for information.
Contentious IP
- Advised a global financial institution pertaining to potential patent infringement of blockchain-related and cryptocurrency-related technology.
- Advised a leading regional provider of transportation and other services pertaining to potential patent infringement in several Asian jurisdictions.
- Advised a governmental entity pertaining to potential patent infringement.
- Advised global technology leader in what is recognized as one of the most complex patent infringement cases in Thai history.
- Advised global technology leader in landmark trade secret infringement case in Thailand.
Tech advisory
- Advised on a complex transactional matter involving the acquisition of over 200 patent assets and licensing of several patent assets.
- Advised on a multi-faceted and multi-jurisdiction transactional deal with a significant focus on highly complex IP and technology; deal involved negotiating licensing of and ownership rights to various forms of existing and future IP; formulating purposively customized royalty structures and fee reduction provisions based on future devaluation or loss of IP; transitional survivability rights to pertinent IP use; formation of a JV for collaborative R&D, manufacturing, licensing, and service offerings; and advising on and structuring of all aspects of the deal based on a variety of multi-disciplinary considerations.
