Emma Smyth
Biography
Emma is an associate in the Dispute Resolution team based in London. Emma's practice includes a broad spectrum of disputes, including commercial litigation and trusts litigation. She also has experience advising on product liability, safety and regulatory compliance.
Emma joined the Baker McKenzie Belfast Center in 2021 and worked as a specialist in the Transaction Support Group, before transferring to the London office to complete her training contract. She qualified into the Dispute Resolution department in September 2025. During her training contract, Emma spent six months on a client secondment at British American Tobacco in the Commercial Litigation and External Investigations team.
Representative Legal Matters
- Acting for an ultra-high-net worth individual on a long-running, multi-billion-dollar, family trusts dispute, seeking to set aside Bermudian purpose trusts in order to return assets to the family heirs and pursuing related claims in a number of other jurisdictions.
- Defending a major financial institution in connection with a multi-million-pound claim brought against it regarding allegations of misrepresentation and negligent advice.
Professional Associations and Memberships
Corporate Responsibility
Emma has worked on several pro bono matters with a range of organisations including Amicus, the Law Society and LawWorks. She presented at a roundtable with representatives from LawWorks and the Law Society considering public access to emergency legal advice in the aftermath of major incidents, including terrorist attacks and civic disasters. Emma has also worked closely with an NGO to draft applications to the European Court of Human Rights.
