Biography

Clarissa Rach is an associate in the Munich Baker McKenzie office and a member of the Information Technology Practice Group. She joined the Firm in 2022. Clarissa studied law at EBS Law School and Católica Lisbon School of Business & Economics (Portugal) with a focus on public economic law. Clarissa also holds a Master in Business Administration from EBS Business School. Before joining Baker McKenzie, Clarissa completed her judicial clerkship at the Higher Regional Court in Frankfurt am Main and at an international law firm in Munich in the field of patent litigation. Clarissa also gained valuable experience in commercial IT and data protection law as a research assistant at an international law firm before she started her judicial clerkship.

Practice Focus

Clarissa's practice focuses on all aspects of information technology and data protection law. The focus of her advice is on German and international clients in the automotive, healthcare, industrial, manufacturing and transport sectors. In particular, she advises clients on data protection and privacy law, IT contract law, compliance issues, e-commerce and m-commerce related issues, questions regarding the implementation of AI systems, data economy and platform regulation, data security issues and many other topics in the area of data protection and IT law. Clarissa supports clients with issues related to the implementation of AI systems, the implementation of internal GDPR compliance systems, and the development and launch of new web stores and apps. She also regularly assists clients with data protection issues in the context of data incidents. In addition, she provides guidance on further regulatory aspects, including compliance with frameworks such as the Data Act, Digital Services Act , Digital Operational Resilience Act, Network and Information Systems Directive (NIS2), and Critical Entities Resilience Directive. Furthermore, Clarissa advises on works council agreements regarding the introduction of IT systems.
