Sebastian Pabian

Sebastian advises insurers, reinsurers and financial institutions on complex litigation, arbitration and regulatory matters. His practice focuses on directors’ and officers’ liability, professional indemnity, financial institutions claims and insurance coverage disputes. He has led matters involving D&O insurance, infrastructure and energy-related disputes, financial misconduct and insolvency issues, and regularly handles cross-border claims. Sebastian also advises insurance companies on regulatory and operational matters, including insurance and reinsurance frameworks, product governance and day-to-day business requirements.

• Represented TUiR Allianz Polska S.A., Chubb European Group SE Branch in Poland, Colonnade Insurance S.A. Branch in Poland and AIG Europe S.A. in complex D&O insurance loss-adjustment and court proceedings involving high-value, cross-border claims.
• Advised and represented a global insurer in a precedent-setting dispute arising from the failed Ostrołęka C power plant project, including D&O insurance claims exceeding EUR 160 million and related loss-adjustment proceedings.
• Advised a leading Japanese life insurer on EU and Polish insurance regulatory requirements, including licensing, reporting, business scope restrictions, dividend limitations and product governance issues.
• Led insurance aspects of Baker McKenzie’s representation of an international insurer in court and loss-adjustment proceedings concerning D&O claims connected with a major Polish state-owned energy company.
• Represented major international insurers in sophisticated D&O liability matters involving regulatory, litigation and coverage issues, including claims with significant financial exposure and cross-border dimensions.
• Managed the legal representation of a leading global e-commerce and technology company in dozens of employment disputes, including complex and precedent-setting cases, overseeing litigation strategy and ensuring a consistent approach across a high-volume portfolio of matters.
• Acted for major international banks in a landmark dispute concerning alleged liability for fraudulent cross-border fund transfers worth approximately EUR 15 million.
• Represented a life insurance company in group litigation concerning unit-linked insurance policies.
• Advised numerous life insurance companies on various aspects of unit-linked insurance policies, including in relation to court proceedings concerning claims by their clients as well as proceedings by the President of the Office for Competition and Consumer Protection.
• Represented a large American insurer in several criminal and civil cases relating to D&O insurance claims, with an aggregate sum of claims of about EUR 10 million.
• Represented a large American insurer in criminal proceedings relating to a loss of about EUR 12 million caused by the employees of an insured bank.
• Represented a consortium of international and domestic contractors in a high profile dispute with the Polish Ministry of Transportation concerning the minister’s decision to declare the expiry of the concession for the construction and operation of the A1 Motorway.
• Represented a Dutch holding company from the insurance sector in a number of cases regarding damage to its reputation, including high-profile and precedential cases against members of the Polish Parliament.
• Advised a large Polish construction company (including successful representation before the Supreme Court of Poland) on a EUR 15 million claim concerning an increase of the remuneration resulting from a contract for works at one of the largest coking plants in Poland.
• Advised a large Polish power producer on a EUR 10 million claim against a contractor in relation to property and business interruption damage caused during the overhaul of a power unit.
• Represented the insolvency administrator of one of the biggest German furniture manufacturers with respect to the bankruptcy proceedings of its 29 Polish subsidiaries.
• Represented various energy companies, including the largest power producers and suppliers in Poland, in several dozen administrative proceedings and court disputes with the Polish Energy Regulatory Office regarding the calculation of stranded costs arising as a result of the termination of long-term power supply contracts.
