Sphesihle Nxumalo is an associate in Baker McKenzie's Antitrust & Competition Practice Group in Johannesburg.

Practice Focus

Sphesihle's experience spans the entire spectrum of antitrust and competition law regulation. He advises local and international clients on the notifiability and compilation of merger transactions to competition authorities in various African jurisdictions. Sphesihle also advises and represents local and international clients on prohibited practices (i.e. cartel conduct, restrictive vertical practices and abuse of dominance), dawn raids and compliance programmes. He has been involved in several high-profile competition matters, and has conducted compliance audits and due diligence investigations on various corporate entities. Sphesihle has acted for clients in various industries including, food and agro-processing, healthcare, infrastructure and construction, banking and financial services, retail and automotive sectors.

Representative Legal Matters

Prior to joining the Firm, Sphesihle handled the following matters:

  • Assisted in advising a global automotive components manufacturer in relation to allegations of cartel conduct.

  • Assisted in advising and representing a multinational services, trading and distribution company and a multinational healthcare company in the in respect of allegations of pre-implementation of a merger (gun-jumping).

  • Assisted in advising on the restructuring and corporatisation of a South African international steel products manufacturer.

  • Assisted in advising an international asset management and banking group in relation to allegations of cartel conduct.

  • Assisted in advising several financial institutions on various antitrust/competition law issues.

  • Advising on and undertaking merger filings in various Africa jurisdictions including Swaziland, Botswana, Kenya, Namibia, Zambia, Zimbabwe and the Common Market for Eastern and Southern Africa.

  • Assisted in advising a South African medical scheme in relation to the Health Market Inquiry.

  • Undertaking internal South African competition law compliance training for a South African healthcare company.

  • Conducted a compliance audit and a due diligence investigation on an international energy provider and global container shipping company.
