Yassmín Muñoz-Nájar Salem
Biography
Yassmin has over four years of experience in dispute resolution in the fields of international commercial arbitration, international arbitration and international law in general. In addition, she has been involved in domestic arbitrations representing clients of different industries. She is currently an associate in the dispute resolution practice in the Lima office and involved in international commercial arbitration, ICSID arbitration and local arbitration matters.
Representative Legal Matters
- Member of the team that represented a leading Spanish business group specializing in the development of public works projects and implementation of construction projects, in two ad hoc UNCITRAL ad hoc international arbitrations seated in Miami, as well as two domestic arbitrations, against the Peruvian Public Institution of Social Security in the Health Sector, regarding two public-private partnerships for the construction and operation of two hospital complexes, the first of their kind in Latin America, with an approximate value of USD 60 million.
- Member of the team in a Lima-based ICC International Commercial Arbitration, representing a consortium of consulting engineers with more than 70 years of experience regarding a project for the improvement and expansion of drinking water supply, sanitation and sewerage systems in Peru. The tribunal dismissed the plaintiff's claims and granted our client's counterclaim in the amount of USD 10 million.
- Member of the team in a UNCITRAL ad hoc international commercial arbitration seated in Mexico, representing an operating arm of an international organization in connection with a contract for the design and construction of a new hospital in Peru. The tribunal dismissed the claimant's claim and upheld our client's counterclaim for approximately USD 8 million.
- Member of the team in an ICSID arbitration under the Mexico-Peru Free Trade Agreement concerning a concession contract for the design, construction and operation of Peru's first nationwide fiber optic network.
- Member of the team in two ICSID arbitrations concerning a concession agreement for the development of the new metro line in Lima.
- Member of the team that represented and is representing an investor in three UNCITRAL arbitrations against a Peruvian public entity regarding a highway concession.
- Member of the team representing a Colombian concessionaire in two domestic arbitrations relating to a road infrastructure concession contract. These arbitrations are seated in Lima and conducted under the rules of the Lima Chamber of Commerce.
- Involved in several other domestic arbitrations related to the energy and transportation industries.
