Valentin Marginter
Biography
Valentin Marginter is an associate in Baker McKenzie's Dispute Resolution Practice Group in Vienna. He advises clients on complex commercial disputes, arbitration and litigation, with a particular focus on commercial, industrial and supply chain disputes, construction and infrastructure disputes, and technology-related disputes. Prior to joining Baker McKenzie in 2022, Valentin worked at a leading Swiss arbitration practice and previously gained experience in EU and competition law at a major Austrian law firm. He has practiced in Austria and Switzerland and is pursuing a PhD at the University of Vienna focusing on the intersection of competition law and dispute resolution. Valentin was a member of the team that won the Werner Melis Award for Best Memorandum for Respondent at the 26th Willem C. Vis International Commercial Arbitration Moot.

Valentin focuses on complex commercial disputes and represents clients in arbitration and litigation proceedings. His practice spans commercial, industrial and supply chain disputes, construction and infrastructure disputes, franchise disputes and technology-related disputes. Valentin has experience acting in proceedings under the rules of leading arbitral institutions, including the ICC, Swiss Arbitration Centre and VIAC, as well as before Austrian courts. He has advised clients in matters involving shareholder and joint venture disputes, technology licensing disputes, construction and infrastructure projects, franchise relationships and insolvency-related claims.
Representative Legal Matters
- Represents a major US food producer in multiple ICC arbitrations and related Austrian court proceedings, including proceedings before the Austrian Supreme Court, arising from joint venture, shareholder, sale of goods and technology licensing disputes.
- Represents an energy infrastructure company in an arbitration against a state from CEE under the Energy Charter Treaty administered by ICSID under its Additional Facility Rules.
- Represents a southeastern European pharmaceutical company in a dispute arising from delayed and defective supply of goods.
- Represented a holding company of a former bank against claims of the insolvency administrator in arbitration proceedings under the Vienna Rules (VIAC).
- Represented Kosovo's state telecommunications provider in a Swiss Rules arbitration seated in Switzerland concerning claims arising from a long-term reseller arrangement for mobile phone credit.
- Represented a leading Austrian supermarket chain in franchise-related litigation against a former franchisee before Austrian courts.
- Represented an Austrian self-storage and logistics network in franchise disputes against former franchisees before Austrian courts.
