Biography

Franco Luna has four years of experience and has dedicated his career to the practice of arbitration and litigation. His main focus lies in disputes against the state, covering a variety of contractual modalities, as well as civil, commercial, administrative and constitutional litigation.

Franco graduated with honors from the Universidad de Lima, where he specialized in dispute resolution. His academic excellence is reflected in his well-received thesis titled "Necessity of Pronouncement of the Arbitration Courts in the Face of Indications of Corruption in Arbitrations with the State."

Practice Focus

Franco has accumulated experience in both domestic and international arbitration, as well as civil, regulatory and construction matters. In addition, he has participated in civil, commercial and administrative litigation and constitutional proceedings.

His professional practice is focused on advising on conflicts against public entities, both in arbitration and in court. Franco has demonstrated his ability in elaborating strategies to request the fulfillment of contractual obligations, the payment of monetary sums and indemnities through arbitration, as well as in the defense against judicial actions in contentious administrative matters.

Franco has also handled civil and commercial disputes, including cases involving the nullity of legal acts, enforcement of awards, obligations to give a sum of money, evictions, property claims, injunctions to recover and retain, bankruptcy, challenges to corporate agreements and nullity of securities, among others.

In addition, Franco has participated in constitutional proceedings related to various matters, including cases requesting the annulment of judicial pronouncements, administrative resolutions and creditors' agreements.

Representative Legal Matters

  • Represented a company in an arbitration against the state. This included requesting the payment of PEN 41 million for the delivery of health-related supplies during the COVID-19 pandemic.
  • Represented an electricity sector company in an arbitration arising from a public-private partnership. This included requesting a declaration of breach of contract by the entity and indemnification for breach of contract in the framework of an energy concession.
  • Represented a construction company in a public procurement arbitration. This included requesting that a public company be required to comply with its contractual obligations in connection with the construction of works within a hydroelectric power plant.
  • Represented an agricultural company in an administrative litigation process. This included requesting that a pronouncement that had rejected a program for the represented company to operate within the country be revoked.
  • Represented an agricultural company in an Amparo proceeding. This included requesting the nullity of a pronouncement by an entity that ordered the closing of its facilities in the country.
