Practice Focus
Kathleen is a general commercial litigator whose practice has a particular focus on class actions and large-scale corporate litigation, including claims for alleged breaches of director duties (e.g. insolvent trading and continuous disclosure claims) and other Corporations Act and related claims. Kathleen also has experience acting on litigious matters across a range of sectors, including claims in the healthcare, product liability and employment spheres.
Kathleen is experienced in acting in claims arising in contract, statute, equity and tort, with particular experience acting in claims filed in the Federal Court and the NSW Supreme Court. Kathleen's experience includes defending clients in class action proceedings filed in both the Federal Court and Victorian Supreme Court.
Representative Legal Matters
- Acting for former directors and officers of the Arrium Group (a formerly ASX-listed Australian mining and materials company) arising from its financial collapse in 2016, including in respect of:
- public examinations undertaken by the Arrium Group's liquidators and a major creditor prior to the commencement of proceedings
- defence of proceedings commenced by a major Australian bank, global bank and various US-based hedge funds in respect of over AUD 350 million in borrowings and over AUD 1.7 billion in debt rollovers
- defence of proceedings commenced by another major bank and two global banks in respect of over AUD 285 million in borrowings
- defence of proceedings commenced by various Arrium entities in liquidation and their liquidators in respect of alleged insolvent trading involving over AUD 480 million in borrowings (understood to be the largest insolvent trading proceedings to go to trial in Australia)
- defence of an ongoing securities class action commenced on behalf of shareholders in the Victorian Supreme Court in respect of carrying values of assets in financial statements and an AUD 700 million capital raising.
Kathleen's representative experience also includes:
- Acting for an Australian marketing and fundraising agency in a class action commenced in the Federal Court alleging sham contracting.
- Acting for an international medical devices company in a class action commenced in the Federal Court alleging negligence and breaches of consumer legislation.
- Acting for a range of domestic and international clients in respect of complex multijurisdictional product recalls and advice in respect of product safety and liability.
- Acting for a US-based construction management firm in obtaining court approval for a scheme of arrangement facilitating the acquisition of an Australian-based entity.
- Acting for a multibillion-dollar Australian superannuation fund in a dispute arising from a change of corporate trustee in respect of a trust whose main assets comprised property worth approximately AUD 100 million.
- Acting for a global pharmaceutical company in respect of freezing orders obtained in context of imminent transaction.
- Acting in a series of employment-related restraint matters, including those involving alleged misappropriation of an employer's sensitive and confidential information
