Biography

Andrea is an experienced dispute resolution lawyer with over ten years of experience. She actively represents the Peruvian State as well as private and public entities in international and domestic arbitrations in highly regulated sectors, especially energy, concessions and construction, with seats in Europe, USA and Latin America, under the most important arbitration rules (ICSID, ICC, UNCITRAL, CIAC, among others).

Andrea completed her master's degree in international arbitration at the University of Miami, having been awarded the White & Case/Carolyn B. Lamm Full Tuition Scholarship and the Baker McKenzie Graduate Legal Study Scholarship. She is committed to the improvement of arbitration, founding a nonprofit organization to promote best practices in the area, coaching young law students who participate in international arbitration competitions (Moots), actively participating as a speaker in events and panels, and publishing books and articles on the subject. 

Representative Legal Matters

  • Led a team on an ad hoc UNCITRAL international commercial arbitration with seat in Mexico, representing an operational arm of an international organization, related to the work contract for the design and implementation of a new hospital in Peru. The tribunal denied the action brought by the claimant and approved the counterclaim brought by the client with an approximate value of more than USD 8 million.

  • Led a team on an ICC international commercial arbitration with a seat in Lima, representing a consortium of consulting engineers with more than 70 years of experience regarding a project for the improvement and expansion of the drinking water supply, sewerage water supply and sewerage systems in Peru. The tribunal rejected the claims of the claimant and approved the counterclaim brought by the client with a value of  more than USD 10 million.

  • Member of the team that represented a leading Spanish business group specializing in the development of public works projects and implementation of construction projects in two ad hoc UNICTRAL international arbitrations with seats in Miami against the Peruvian public institution of social security in health, regarding two public-private partnerships for the construction and operation of two hospital complexes, first of its kind in Latin America with an approximate value of more than USD 54 million.

  • Member of the team that represented a Peruvian company owned by a Canadian investing group with global presence in more than 30 countries with a dispute of more than USD 700 million, in three ad hoc UNCITRAL international arbitrations against a Peruvian public entity, in disputes of very complex nature. The seat of the arbitrations was Washington, DC, and the disputes were related to a high-profile concession contract of 30 years, for the construction, operation and maintenance of highways in Lima city. The tribunal interpreted the contractual management mechanism in a favorable manner to the client, setting an important precedent for the industry and other concessions in Peru.

  • Member of the team that represented a Peruvian company owned by a French business group in the construction sector with a global presence, in two international arbitrations before the International Arbitration Chamber of Paris, with seats in Paris, against a Peruvian public entity regarding breach of the 40 years via a concession contract and its annulment. The Arbitral Tribunal recognized several of the client’s petitions.

  • Advised private energy, technology and construction companies to prevent and resolve disputes regarding contract execution and regulatory matters.
