Who is the controller of my personal data?
Each of the member firms and entities of Baker McKenzie acts as an independent controller of personal data in relation to your use of the Avature platform.
If you apply for a specific role with Baker McKenzie, the controller of your personal data is the Baker McKenzie entity to which you are applying for a position (the "Firm"). For the name and contact details of the Baker McKenzie member firms and entities, please see here.

Registration with the Talent Community
If you would like to receive information about employment opportunities at Baker McKenzie, you may register with the Baker McKenzie Talent Community. You will be asked to provide some basic information about yourself such as the following:
Preferred first name, preferred last name, contact e-mail, phone number, current/most recent job title, current/most recent employer, location of residence, location of interest, areas of interest and the talent community you wish to join.
Some of these fields are required while others are optional. Required fields are marked with an asterisk. There is no downside if you do not complete the optional fields but you may be required to provide the information at a later date if you proceed with an application for employment.
Please note that if you choose to provide details of your current employer, we will never contact them without your express prior permission.
It is not necessary to upload your CV/resume when you register but if you choose to do so, the system will use information from your CV/resume to help pre-populate the Talent Community registration fields. The information in your CV/resume also helps us to identify which open roles are most likely to be relevant for you based on your experience.
Contact regarding future job opportunities
Baker McKenzie will use the information you provide to identify job opportunities which are most likely to be of interest to you. This will be based on: (i) the information contained in your CV/resume (if provided) such as education, professional qualifications, career history, other skills, etc, and (ii) the preferences you select when completing the registration form such as location/areas of interest and the relevant talent community. Please make your selections carefully to help ensure we are only sending you information about employment opportunities which are likely to be of interest to you.
We will contact you from time to time to confirm that you wish to remain a member of the Talent Community and/or update your preferences.
When submitting the registration form, you will be asked to confirm that: (i) you have read and agree to the terms of this Platform Privacy Policy; and (ii) you agree to be contacted by e-mail with information regarding job opportunities which may be of interest to you.
If you no longer wish to receive e-mails regarding job opportunities, you can unsubscribe at any time using the link provided in the e-mails or when we contact you to update your preferences. Alternatively, you can request the deletion of your profile in the Talent Community subject to applicable retention policies and applicable laws.

Job Application (External Candidates)
If you are an external applicant, you may be asked to provide the following information about yourself:
Preferred first name, preferred last name, current/most recent job title, current/most recent employer, contact email address, phone number, location (residence), country/province/region/state (residence), city, zip/postal code, whether you are you legally authorized to work in the location you are applying to, whether you now or in the future will require sponsorship for an employment visa, details of your current visa/residency status, whether you previously been employed by Baker McKenzie, how you heard about this role, full name of any employee who brought the role to your attention, if you saw the vacancy on a job board, the name of the relevant job board, whether you are a relative of a partner or employee at the Firm and if so provide the full name of the relevant employee or partner, whether you have a LinkedIn profile, what are your annual salary/compensation expectations, details of your work experience, education, bar details, language skills, geographic mobility, skills, areas of interest, and equal opportunity information, where applicable in the country to which you are applying.
In some countries we may be required to record your legal full name or preferred full name in alternate languages or as shown on your ID/Passport.
You may copy and paste or upload a copy of your CV/resume as part of the application process. This is not essential - it just means that you will be required to complete the relevant fields in the application manually. Alternatively, you have the option of importing the details from your LinkedIn or Facebook account. Where you upload your CV/resume or import information from another source, the system will use the information to pre-populate the fields in the application form. If you are already registered as part of the Baker McKenzie Talent Community, any data you have provided may also be used to pre-populate your application form.
Some fields are required while others are optional. Required fields are marked with an asterisk. There is no downside if you do not complete the optional fields but you may be required to provide the information at the onboarding stage if your application is successful.

If you are providing personal data relating to another individual (e.g. member of the Baker McKenzie workforce to whom you are related or who brought the role to your attention), you are responsible for ensuring you have their consent to provide that information.
In order to submit your application, you will be required to create an account (if you have not already done so). You will also have the options of withdrawing your application, editing your profile and requesting the deletion of your profile. Please note that your request for deletion will be considered in accordance with applicable data privacy laws and will be subject to any legal retention rights or obligations the Firm may have in connection with any employment application.
Local Data Privacy Notice
Before you submit your application, you will be directed to read the Local Data Privacy Notice which applies for the specific location in which you are applying for the role. Please select the relevant Local Data Privacy Notice from the list.
In some locations, different Local Data Privacy Notices may apply depending on whether you are applying for a role as a business professional or as a lawyer. Please select the one which most accurately describes the role.

This Platform Privacy Policy describes how personal data is processed in the context of the global Avature platform while the Local Data Protection Notice provides additional detail on how personal data is processed in the location to which you are applying. This varies from one country to another based on local laws and/or recruitment practice.
If your application is successful, the details you have provided as part of your application will be transferred across to the Firm’s global human resource management platform, Success Factors, and used to create a basic employee record for you.
Some of the information you provide as part of your application is specific to the role for which you are applying and will not be displayed within your platform profile. In particular, the following categories of data will not be displayed in your profile:
Name of any employee who referred you to the role, whether you are a relative of a partner or employee to whom you are related, annual salary/compensation expectations, equal opportunities information (where applicable), any job specific information and details of any application which you have withdrawn.
All other information will remain in your platform profile for ease of reference in the event that you wish to apply for another position subject to the applicable retention policy.
Contact regarding future job opportunities
When you submit your application, you will also be asked if you are happy for Baker McKenzie to retain your details so we can contact you regarding job opportunities which may be of interest to you.
If you no longer wish to receive e-mails regarding job opportunities, you can unsubscribe at any time using the unsubscribe link in the e-mail or requesting the deletion of your profile (subject to applicable laws and the relevant record retention policy.

Job Application (Internal Candidate)
If you are an internal applicant, the following information may be processed in connection with your application:
Preferred first name, preferred last name, legal first name, legal last name, contact email address, skills, areas of interest, current/most recent job title, functional manager, office, company (current/most recent employer), region, location, time zone, business unit, function, sub-function, billing title/job level, pillar, job classification, cost center, PBS cost center (if applicable), employee class, languages, whether you have informed your manager about your interest in this role, whether you are legally authorized to work in the country to which you are applying, whether you require sponsorship for an employment visa now or in the future, details of current visa/residency status (if applicable) and annual salary/compensation expectations.
You may copy and paste or upload a copy of your CV/resume as part of the application process. This is not essential – it just means that you will be required to complete the relevant fields in the application manually. Please note that if you have not informed your current manager of your interest in the role, we will not do so without your express prior permission. You are not required to tell them if you prefer to keep applications confidential; however, we strongly encourage you to be open with them, particularly once you are progressing in the process (post any informal exploratory conversations) as they may be a good source of guidance as well as being able to input about opportunities for you.
In order to submit your application, you will be required to create an account. You will also have the options of withdrawing your application, editing your profile and requesting the deletion of your profile. Please note that your request for deletion will be considered in accordance with applicable data privacy laws and will be subject to any legal retention rights or obligations the Firm may have in connection with any employment application.

Referrals by Baker McKenzie employees
Current Baker McKenzie employees may use the Avature platform to refer individuals from outside Baker McKenzie either:
- to the Talent Community; or
- for Specific Roles.
You are responsible in all cases for ensuring that you have the consent of the relevant individual to make the referral and provide their personal data in connection with the referral.
The referrals process is only available in respect of candidates outside Baker McKenzie and not any internal candidates.
Specific Roles - the categories of data collected in the context of referrals for specific roles are as follows:
Preferred First Name, Preferred Last Name, Contact Email Address, Phone Number, Current/Most Recent Job Title, Current/Most Recent Employer and description of why the person is being recommended for the role
Talent Community - the categories of data collected in the context of a referral to the Talent Community are the same as for Specific Roles save that instead of providing details of why you would recommend the individual for the role, you will be asked to indicate which of the following pipelines the individual is suitable for:
Business Professionals; Early Careers; Lawyers/Associates; Partners
Some of these fields are required while others are optional. Required fields are marked with an asterisk. There is no downside if you do not complete the optional fields but the individual who is being referred may be required to provide the information at a later stage if they proceed with an application.
Please note that if you choose to provide details of the individual’s current employer, we will never contact them without the express prior permission of the candidate.
In each case, you will also be asked to upload the individual’s CV/Resume and provide specific confirmation that the individual has consented to their details being provided.
Relevant individuals will receive a system e-mail to inform them that they have been referred to the Talent Community or for a specific role (as applicable). They will be requested to opt-in or reminded of their right to opt-out depending on which rules apply in their location.
If the individual wishes to apply for the role they have been referred for, they can do so in the normal way as further described in the Job Application - external candidate section above.
Please note that your account will be completely separate from that of the person who referred you. That person will have a short record in their own profile (i.e. name, job or pipeline referred for, date of referral) that they referred you and will be able to see the referral status (i.e. in progress, hired, no longer under consideration). However, that person will not be able to see any additional information that you provide as part of any job application.

Introduction by a Recruitment Agency
If you are introduced to Baker McKenzie by an external recruitment agency, the agent will confirm that they have your consent for us to proceed with considering your application and provide your personal data including, where possible, your contact e-mail. For completeness, where your personal contact e-mail has been provided, we will contact you to -re-confirm this consent (which may be an opt-in or opt-out depending on where you are located). It is important that you respond to ensure that the application is not discontinued.
Subject to the above, we may process the following categories of personal data when considering you for employment:
Preferred First Name, Preferred Last Name, Legal First Name, Legal Last Name, Contact Email, Address, Phone Number, Location (Residence), Current/Most Recent Job Title, Current/Most Recent Employer, whether you are legally authorized to work in the relevant location, whether you will now or in future require sponsorship for employment visa, current visa/residency status, whether you have previously been employed by Baker McKenzie, Work Experience, Education, Languages, why you have been recommended to Baker McKenzie, any other notes or questions relevant to your submission as a potential candidate.
The relevant details will be submitted by the recruitment agent on your behalf. If your CV is uploaded, some of the information may be parsed from your CV to complete the above fields.

Direct Approach by Baker McKenzie
In its continuous drive to attract the best talent, Baker McKenzie may review publicly available information on third party platforms such as LinkedIn, etc. to identify individuals who may be suited to particular roles or talent communities. Baker McKenzie will only seek to contact you via the permitted communication methods on the relevant third party platform (e.g. In-mail or equivalent) and subject to your user settings. Baker McKenzie is not responsible for any processing of your personal data by the providers of such third party platforms in respect of which the platform provider shall remain the controller of your personal data. If you choose to start interacting directly with Baker McKenzie via the Avature platform, Baker McKenzie will be a controller of any personal data you submit via the platform and the relevant terms of this Privacy Policy shall apply.

Information for Recruitment Agents
If you are an external agency recruiter with an existing contractual relationship with Baker McKenzie, we will create a basic profile for you in Avature so that you can access the agency portal.
The following categories of your personal data will be processed in this context:
First Name, Last Name, Agency Name, Work Email, Position/Title
You may use the agency portal to submit candidates for jobs subject to the terms of your contract with Baker McKenzie.
As you will be providing personal data relating to third parties (i.e. potential candidates), you are responsible for ensuring you have their consent to provide that information. Please ensure when you submit the candidate’s data that you provide their personal contact e-mail so that we can contact them to re-confirm this consent (which may be an opt-in or opt-out depending on the location). Failure to do so may result in the candidate’s application being discontinued and/or their data being deleted.

What can I do within my profile?
If you are an external applicant and wish to submit a job application, you will be required to register an account within the Avature platform. Existing employees will have a basic account already registered for them on the system. This is necessary to facilitate single sign-on and to ensure that members of the Baker McKenzie workforce are assigned the correct user based permissions.
Once you have an account, a number of options are available to you as described below.
Review or edit your profile information - you can review or edit your profile information at any time. Please note that some exceptions apply. For example, if you are an existing employee of Baker McKenzie, any information relating to your application that was sourced from Success Factors can only be edited in Success Factors. You may also request the deletion of your account. This will be considered in accordance with data privacy laws and any legal retention rights or obligations the Firm may have in connection with any employment application.
View your job applications – you can view the jobs you have applied for and check the status of those applications.
View recommended jobs - you can view a list of recommended jobs based on the information contained in your CV/resume, jobs which you applied for previously, skills and any areas of interest which you specified in your profile. If you would like to be notified of jobs more specifically tailored to your preferences, we would recommend signing up for job alerts as described in the Create Job Alerts section below.
Create Job Alerts - you can register to receive job alerts regarding positions which may be of interest to you. To help ensure you receive alerts about jobs which are most relevant to your interests and experience, you will be asked to complete the following fields:
- Keywords
- State/Province/City
- Alert frequency (e.g. weekly, monthly, etc.)
If you no longer wish to receive such job alerts you can unsubscribe at any time by deleting the job alert within your profile.
What legal bases are relied on for processing personal data?
The legal bases which Baker McKenzie relies on to process your personal data will depend on the relevant category of data, how you are using the Avature platform and the specific use case that applies to you (e.g. job application, registration for the Talent Community, etc.).
Subject to any regional variations based on local laws, the legal bases for processing may include:
- processing which is necessary in order to perform a contract with you;
- processing which is necessary for the Firm's legitimate interests;
- consent (subject to the additional points below); and/or
- processing which is necessary for compliance with Baker McKenzie's legal obligations.
Where the Firm is relying on legitimate interests as the legal basis for processing, such legitimate interests include attracting the best talent to Baker McKenzie, assessing your suitability for employment by the Firm, managing the recruitment and onboarding process efficiently, managing the Firm’s overall business operations effectively, performing statistical analysis to review and benchmark the Firm's practices, etc.
Consent
Where required or permitted under local laws, the Firm may also ask for your consent to process personal data in specific circumstances during the recruitment process or in connection with your use of the Avature platform. Such circumstances may include conducting background checks prior to your employment (to the extent permitted by law) and retaining your personal data to inform you of any future vacancies.
Right to withdraw consent
Where we rely on your consent as a legal basis for processing, and you wish to withdraw your consent, please contact us using the contact details below or as otherwise indicated in the context of the relevant use case referred to in this Privacy Policy or in any communication that we send to you. Please note, however, that if you withdraw your consent in certain scenarios, such as a job application, we may not be able to proceed with your application.
Special categories of personal data
It is not anticipated that any special categories of personal data will be processed unless you apply for a specific role with the Firm. Please check the terms of the relevant Local Data Protection Notice for details of the categories of special categories of data and purposes of processing. Subject to applicable laws, examples of special categories of data which may be relevant include:
Data relating to health or disability – to accommodate any reasonable adjustments you may require and for compliance with legal obligations.
Criminal records – as part of background checks in relation to you, where relevant and proportionate in relation to the role you are applying for and to the extent permitted by law.
Equal opportunities/inclusion and diversity data - details regarding your racial or ethnic origin, religious or philosophical beliefs, health and medical data and sexual orientation.
The legal bases for processing special categories of personal data may include explicit consent and/or processing which is necessary for the exercise or performance of employment law rights or obligations. Please check the relevant Local Data Protection Notice for further details.
Who will my personal data be shared with?
Your personal data will only be shared to the extent reasonably necessary to achieve the purposes of processing as further described below.
Within the Baker McKenzie offices: the Firm may disclose or otherwise allow other entities within Baker McKenzie access to your personal data where necessary to achieve the purposes of processing (e.g. to consider your employment application, registration for the Talent Community, considering you for future roles, etc.). Other Baker McKenzie offices may process your personal data as necessary for the provision of general administrative and business support services (e.g. technology, human resources, finance, legal compliance, etc.). All access is on a strict need-to-know basis in accordance with a defined system of role based permissions.
With external service providers: personal data may be shared with external service providers providing general administrative and business support services to the Firm or as necessary to achieve the purposes of processing. All service providers are subject to rigorous review from a data privacy and information security perspective as part of the vendor on-boarding process. The Firm adopts appropriate contractual and other measures, in accordance with applicable laws, to ensure personal data remains protected notwithstanding the use of external service providers.
With regulators, authorities, and other third parties: in limited cases, personal data may be disclosed to third parties (e.g. regulators, courts or other competent authorities, external legal advisors, insurers, etc.) where necessary in connection with legal proceedings or defending legal rights.
International Data Transfers - where will my data be processed?
The recipients with whom your personal data may be shared (described above) may be located outside the European Economic Area ("EEA") or other country of origin in a country which is not regarded by data supervisory authorities as providing an adequate level of protection for personal data. To address this, the Firm has adopted appropriate contractual measures (including the EU Standard Contractual Clauses and other locally required equivalent clauses) and other measures with external service providers and within Baker McKenzie International to ensure your data remains protected in accordance with applicable laws.
Rights regarding your personal data
Depending on your location, and applicable laws in any location where you apply for a job, you may have certain rights regarding the personal data you provide us including:
Right of access: You have the right to confirm whether your personal data is being processed and to request access to that personal data;
Right to rectification: You have the right to rectify inaccurate or incomplete personal data which we process concerning you;
Right to erasure (right to be forgotten): You have the right to request that we erase personal data concerning you in certain circumstances;
Right to restriction of processing: You have the right to request that we restrict processing of your personal data;
Right to data portability: You have the right to receive personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and you may have the right to transmit that data to another entity; and
Right to object and rights relating to automated decision-making: Under certain circumstances you may have the right to object at any time to the processing of your personal data, including profiling, by us and we can be required to no longer process your personal data.

Use of Artificial Intelligence
The Firm may use Artificial Intelligence ("AI") technology to support the processing of personal data for the purposes referred to in this Privacy Policy. All such AI technology is subject to robust prior screening to ensure that it meets applicable ethical, legal and contractual requirements including in respect of data privacy and information security. The Firm has adopted appropriate policies and training for its workforce governing responsible use of AI technology to ensure that personal data remains adequately protected. In particular, the use of AI to make decisions affecting individuals by solely automated means (including in a recruitment context) is strictly prohibited.
How long will Baker McKenzie retain personal data?
Baker McKenzie will only retain your personal data in identifiable form for as long as necessary for the purposes for which it is collected. This is subject to any legal and/or regulatory retention obligations or other legitimate reason which the Firm may have to retain data. Retention periods vary depending on location and the specific use case which is relevant for you. Please note that Baker McKenzie may also retain and process data in aggregated and anonymised data (from which it is no longer possible to identify any individual) for statistical analysis and reasonable reporting purposes.

Baker McKenzie uses certain cookies, web beacons, and similar tracking technologies (collectively, "cookies") on the Avature platform. A cookie is a small text file which involves data being placed on your device when you visit a website. The text file is stored and later retrieved from your device when you re-visit the site

Necessary Cookies: these cookies are essential for the basic functioning of the Avature platform. They enable core functionalities such as user sessions, etc.

Performance Cookies: these cookies collect information about how users interact with the Avature platform.
