Biography

Jakub Szewczak is an advocate and senior associate in the Dispute Resolution and Arbitration team at Baker McKenzie's Warsaw office. He is experienced in handling commercial and post-M&A disputes, both in litigation and arbitration. Jakub is also highly regarded for his experience in criminal law, particularly white-collar crime proceedings.

Jakub has extensive experience in advising clients on a wide range of litigation and arbitration matters. He focuses on post-M&A disputes, as well as shareholders litigation and disputes related to the liability of members of the governing bodies of commercial companies. Jakub also has proficiency in regulatory litigation.

  • Represented an insurance company in a precedential case concerning a cross-border motor third-party liability insurance activity.
  • Represented a Polish development institution in a dispute relating to the non granting of state aid to an entrepreneur.
  • Represented a property development company in proceedings concerning the acquisition of real estate in Warsaw– total claim amount: PLN 192 million.
  • Represented the insolvency administrator of Polish bank in three cases before the Court of Justice of the European Union (CJEU) relating to consumer contracts, in connection with a challenge to terms deemed unfair under Council Directive 93/13/EEC of 5 April 1993 on unfair terms in consumer contracts.
  • Represented a Polish company in litigation against former members of the management board and supervisory board.
  • Represented a Polish company from the automotive sector in JAMS arbitration against a U.S. company regarding the alleged defects of manufactured parts.
  • Represented a Spanish manufacturing company in a post-M&A ICC arbitration concerning violation of the representations and warranties.
  • Represented an individual investor in a post-M&A ICC arbitration against the buyer concerning the payment under the earn-out clause.
  • Represented an individual investor in a post-M&A SAKIG arbitration concerning the payment under the SHA – total claim amount over EUR 60 million.
  • Represented a Polish bank in high-profile litigation against a prominent individual in the financial sector – total claim amount over PLN 1 billion.
  • Represented energy company in series of court disputes with the president of the Polish Energy Regulatory Office regarding the calculation of the stranded costs arising as a result of the termination of long-term contracts for the supply of power and energy – total claim amount over PLN 300 million.
