Melanie Ho

Melanie has extensive experience in handling complex energy and infrastructure projects, as well as government procurement projects, EPC contracts of projects, real estate development, and insurance claims.

Additionally, Melanie is also experienced in dispute resolution of project dispute and has experience in advising independent power producer (IPP) clients and Taipower contractors in power projects.

Power

• TPC undersea cable project: Acting as the contractor consortium's legal counsel on the turnkey contract with Taiwan Power Company (Taipower) for the Taiwan Penghu undersea cable project; advising on construction-related issues; representing the client for claims in PCC mediation proceedings and court mediation and litigation proceedings.
• Taipower Offshore Wind Farm Phase 1: Acting for European EPIC contractor to claim for additional cost in PCC mediation proceedings; advising on EPC contract related issues.
• Representing a Japanese company, the EPC contractor for Taipower Talin Coal Fired Power Plant Renewal Project to claim for LD deduction and EPC Contract performance issues in PCC mediation proceedings.

Oil & Gas

• Northern LNG Receiving Terminal Project: Acting as the general legal counsel for CPC Taiwan, a state-owned petroleum corporation and owner of the project, on various government procurement issues and project contracts; advising and representing the client on various disputes raised by contractors in mediation and litigation proceedings.
• LNG Supply and Purchase Agreement: Representing the purchaser to negotiate the long-term contract with the Middle East state-owned gas corporation, gas suppliers from Asia and US energy companies.
• Northern LNG Receiving Terminal Project, Taichung Plaint Phase III: Acting as the general legal counsel for CPC Taiwan in the project in various government procurement issues and project contracts; advising and representing on various claims filed raised by contractors regarding LNG storage tank EPC project and regasification facility EPC project, etc.

Transportation

• Taiwan High Speed Rail System: Representing THSR for claims in arbitration proceeding.
• Taoyuan International Airport Access MRT System Project: Assisting the foreign contractor to participate in the tendering proceedings of the Engineering and Maintenance (E&M) system of the project, including preparation for tendering documents and advising the client on various procurement law issues during the tendering process, and after the project was awarded to the client, advising on system contracts, project consultancy contracts and subcontracting issues.

Insurance

• Advised and represented multiple property insurers, including Hotai, Fubon, MSIG Mingtai and Union, etc. in claim assessment/ analysis, negotiation, and dispute resolution in relation to insurance subrogation lawsuit filed by the insurers and claim lawsuit filed by the insured in court proceedings and mediation proceedings involving CGL policy and EAR/CAR policy etc., including property damages and business interruption losses, etc.
• Advised several loss adjusters, including McLarens and Sedgwick, etc., in claim assessment/ analysis and negotiation, involving CGL policy and EAR/ CAR policy etc., including property damage and business interruption losses.

Other Related Government Procurement

• Representing a number of multinational corporations in relation to various government procurements' tendering proceedings, disputes and claims against government agencies.
• Advised on a local client regarding the dispute on development issues with the Ministry of National Defense’s ROT project and represented it in the claim against the MoND in arbitration.
