Biography

Scarlett is an associate in Baker McKenzie's Dispute Resolution Group based in London. She completed her Training Contract at Baker McKenzie between 2019-2021 and joined the Dispute Resolution team as an associate in March 2021. Scarlett's practice spans commercial litigation, insolvency and international arbitration, with a recent focus in the firm's TMT space.

Representative Legal Matters

  • Defending litigation pursued by Crypton Digital Assets Limited against our client, Blockchain Group Holdings, to recover damages said to result from the collapse of a proposed acquisition. The matter included claims to breach of contract, inducement to breach employment contracts and appropriation of assets including intellectual property.

  • Acting for BNPP in connection with a complex bond claim against Uro, a Spanish property holding company. Uro borrowed EUR 1.35 billion from Silverback. As a result of Santander acquiring Uro in 2020, they were repaid early and in full. A dispute has arisen as to whether Uro is required to repay not only the EUR 1.35 billion value of the underlying bonds, but also a premium of approximately EUR 250 million. The Court fully dismissed Uro’s application and ordered that the case should proceed to trial.

  • Acting for Citibank in its capacity of Note Security Trustee for several billion dollars of finance provided to the now collapsed Greensill group. Various entities within the Gupta Family Group failed to service or repay debt in excess of GBP 570 million and we were instructed by Citibank to issue winding up petitions against three Gupta Family Group companies.

  • Representing Dubai Islamic Bank PJSC, the largest Islamic bank in the UAE, in multijurisdictional proceedings arising from a c. USD 500 million large-scale receivables fraud and a settlement of claims in the case with fraudster, Charles Ridley.

  • Representing a Middle Eastern construction company in a USD 500 million ICC arbitration brought by a major subcontractor on the construction of an airport. The claim relates to project delays, disruption, changes in the law and changes to the scope of work.
