In a recent article for Bloomberg Law, Baker McKenzie attorneys Justine Phillips and Adam Aft discussed growing litigation and governance risks tied to AI-driven coding. The article emphasized the potential litigation exposure companies may face if vulnerabilities in AI-generated code result in data breaches.
In the article, Justine explained that organizations integrating AI into development workflows may need to document how such tools are used in order to demonstrate that they have met reasonable security standards in the event of a breach. Adam underscored the importance of careful risk assessment when deploying AI in sensitive environments. He noted that organizations handling regulated data should be thoughtful about when and how they integrate AI technologies into systems that process that data.
