In brief

On 28 May 2026, the Central Bank of the Argentine Republic (the BCRA) issued Communication “A” 8442 (the “Communication”), introducing a significant relaxation to the Foreign Exchange regime (the “FX Regime”) by establishing a new mechanism to access the Foreign Exchange market (the “FX Market”) and prepay financial debt prior to its maturity.

In depth

Among the main measures introduced by the Communication, we highlight the following:

  1. New early prepayment mechanism using funds from related parties

Access to the FX Market for the early prepayment of principal and interest in financial debt prior to maturity is allowed, provided certain specific conditions are met, including the following:

    1. The funds used must be transferred to the client’s local account by an individual or legal entity that directly controls the client, or by entities within the same economic group.
    2. The funds used must originate from the settlement in the FX Market of new foreign financial indebtedness or debt issuances carried out by such entities.
    3. Access to the FX Market must take place within 72 business hours following the settlement of the financing referred to in subsection (b) above.
  2. Treatment for foreign exchange sworn statements

Peso-denominated transfers related to these transactions will not be taken into account for purposes of the sworn statements on related parties under the FX Regime.

In all cases, the above is subject to compliance with the remaining applicable requirements under the FX Regime.

The Communication entered into force on 29 May 2026.
