In brief

On 9 April 2026, the Central Bank of the Argentine Republic (BCRA, after its Spanish abbreviation) issued Communication “A” 8417 (the “Communication”), introducing certain modifications to the Consolidated Text on Foreign Exchange and Foreign Trade (the “FX Regime”).

The modifications include, among other matters, the elimination of the requirement to settle proceeds from exports carried out by individuals, the extension of deadlines for the inflow and settlement of foreign currency from exports by legal entities, the easing of payments of financial indebtedness, the introduction of a new regime for foreign currency hedging transactions, and a new sworn statement for individuals transferring foreign currency abroad.

In depth

Among the main measures adopted by the Communication, the following stand out:

  1. Exports of goods and services by individuals

An exception is introduced to the obligation to settle proceeds from exports of goods and services carried out by individuals, provided that the funds are brought into the country through the official foreign exchange market (“FX Market”) within the applicable regulatory timeframes and that the conditions set forth in the FX Regime are met.

  2. Deadlines for the inflow and settlement of foreign currency from exports of goods

The maximum period applicable to the inflow and settlement of foreign currency derived from exports of goods is increased to 180 calendar days where the importer is a company controlled by the Argentine exporter, provided that certain requirements set forth in the FX Regime are met.

Furthermore, the period for the inflow and settlement of foreign currency from exports of goods to unrelated counterparties is extended to 365 calendar days for certain goods.

  3. Payments of securities and financial debt with related parties

Access to the FX Market is permitted for the payment of principal and interest on certain securities up to three business days prior to their maturity. Likewise, the requirement to obtain prior approval from the BCRA to access the FX Market for the payment of principal on certain financial indebtedness with related parties is eliminated, provided that certain conditions are met.

  4. Financial indebtedness with related parties

As from 10 April 2026, clients are required to submit a sworn statement undertaking not to purchase securities settled in foreign currency for a period of 90 calendar days, whether directly or indirectly or on behalf of third parties, subject to certain expressly provided exceptions.

  5. Foreign currency hedging contracts

A new section is incorporated into the FX Regime allowing access to the FX Market for the payment of premiums, the posting of collateral, and settlements related to foreign currency hedging contracts, provided that certain requirements are met.

The Communication entered into force on 10 April 2026.
