Andrew Prowse is a special counsel in the Dispute Resolution Group of the Melbourne office of Baker McKenzie

Practice Focus

Andrew's practice focuses on large-scale commercial litigation. He has extensive experience in complex shareholder disputes and in major proceedings concerning allegations of misleading and deceptive conduct, breaches of warranty and breaches of the Corporations Act. Andrew also has experience in conducting and managing various interlocutory aspects of large commercial litigation, including discovery, expert evidence and the hearing of interlocutory applications.

Representative Legal Matters

  • Acted for various parties in complex post-acquisition disputes in the Supreme Court of Victoria and Federal Court of Australia, including allegations of fraud, misleading and deceptive conduct and breaches of directors duties.
  • Acted for various shareholders of a large privately held manufacturing business in the Supreme Court of Victoria in relation to their ownership of that business.
  • Acted for and against warranty and indemnity insurers in relation to various post-acquisition disputes, including allegations of breach of warranty and misleading and deceptive conduct.
  • Acted for VicForests in various high-profile environmental litigation in the Supreme Court of Victoria, Federal Court of Australia and High Court of Australia.
  • Acted for the Australian Competition and Consumer Commission in various matters, including proceedings against Medibank Private Limited and NIB Holdings Limited in the Federal Court of Australia.
  • Advises in relation to directors duties, insolvency, fiduciary relationships (including trustees and directors), interpretation of statutory and other legislative instruments and contractual interpretation (including exclusion and limitation of liability, scope of works and rights of termination).
