
Richard Molesworth
Biography
Richard is a partner in the Baker McKenzie Dispute Resolution team based in London and he specialises in international arbitration. He has advised on and appeared in arbitrations administered under many of the most common arbitration rules, including LCIA, ICC and UNCITRAL rules, and seated in a number of different arbitral seats.
Richard’s practice involves complex, cross border disputes and he has experience of a range of dispute resolution processes, including litigation, arbitration and mediation. He primarily advises on international arbitration and commercial litigation, with a particular focus on post-M&A and joint venture disputes.
His practice also includes advising on corporate transactions where there is a significant risk of disputes arising, including (amongst other matters) compliance with pre-completion covenants, conditions precedent and the exercise of options and drag-along rights.
Representative Legal Matters
Recent projects with which Richard has been involved include:
- Acting for a major oil company in UNCITRAL proceedings defending an indemnity claim following the sale of a downstream business and counterclaiming for failure to refund sums recovered by the target company post-completion
- Advising a private equity fund in VIAC arbitration proceedings for breach of warranty in connection with an investment in the leisure industry
- Advising a private individual in the banking industry in an ICC arbitration relating to the purchase of shares in a Latvian bank and allegations of a failure to comply with pre-completion obligations to obtain third party approvals
- Acting for a manufacturer in the oil and gas sector defending a claim for breach of restrictive covenants in a joint venture agreement in an ICC arbitration
- Acting for a manufacturer in the oil and gas sector bringing a claim for failure to fund a joint venture in breach of the joint venture agreement in an ICC arbitration and advising on the enforcement of the arbitral award
- Acting for two multinational groups in the shipping industry in an ICC arbitration defending a claim for unfair prejudice and breach of notice procedures in relation to a share issue
- Acting for an automotive parts manufacturer in English court proceedings on the enforcement of security over shares in a joint venture company and the valuation of the shares
- Advising a commodities trader in LCIA proceedings in relation to the purported exercise of an option to purchase additional quantities
- Advising a major construction company on claims relating to delay and disruption arising out of an airport construction project
- Advising an EPC contractor in ICC proceedings in relation to claims by a subcontractor for alleged modifications to the original scope of work in relation to a significant upgrade of an oil refinery
- Acting for a major oil company in LCIA proceedings against an Italian oil and gas company in respect of unpaid invoices

- Richard has advised on a number of pro bono matters including advising on breach of contract claims and providing training to Reprieve on interviewing witnesses and drafting witness statements.
