Biography

Mustafaen is an associate in the Dispute Resolution practice at Baker McKenzie in London, specializing in international arbitration, public international law, and complex commercial litigation. His practice encompasses investment treaty arbitration (ICSID, UNCITRAL), commercial arbitration (ICC, LCIA, DIAC, and ad hoc proceedings), anti-suit injunctions, and the cross-border enforcement of arbitral awards and judgments.

Mustafaen has acted for states, financial institutions, and multinational corporations in high-value, high-profile disputes, with a particular focus on public international law matters, including investment treaty-based disputes, international commercial arbitration, state immunity and jurisdictional challenges, sovereign debt and enforcement against state assets and geopolitical risk and sanctions-related litigation. Mustafaen regularly advises on arbitrations seated in the GCC and MENA jurisdictions.

Mustafaen was a Frank Knox Fellow at Harvard Law School where his research focused particularly focused on Public International Law. Mustafaen was seconded to the UNHCR where he regularly interacted with international stakeholders on matters to do with public international law and international refugee law.

  • Acting for a mining company in a USD 500 million ICSID arbitration against a State regarding the expropriation of mining facilities.
  • Advising a global conglomerate on a potential USD 2billion investment treaty arbitration against Russia.
  • Advising a Bahraini aluminium manufacturer on an ICC arbitration with an Egyptian entity.
  • Advising a global pharmaceutical company on a $100 million post M&A dispute.
  • Acting for a bulge bracket investment bank in their appeal against the denial of an anti-suit injunction (Deutsche Bank AG v RusChemAlliance LLC [2023]).
  • Acting for a private enterprise in commercial litigation between an international conglomerate and an African State regarding the nexus between state immunity and the enforcement of ICSID awards.
