Łukasz Hejmej

Łukasz focuses on financial institutions litigation, post-M&A and corporate disputes, and commercial arbitration. He advises on claims involving financial products, professional and directors’ liability, securities, shareholder rights, purchase-price and earn-out mechanisms, and restructuring and insolvency issues. His experience includes leading multi-jurisdictional disputes governed by different substantive and procedural laws and coordinating court proceedings, international arbitration, interim relief and award-enforcement strategies. He also represents banks in consumer mass litigation and related proceedings before the Court of Justice of the European Union.

• Advising mBank S.A., PKO Bank Polski S.A., Raiffeisen Bank Polska S.A., Deutsche Bank Polska S.A., BNP Paribas Bank Polska S.A., and the Polish Bank Association on large-scale Swiss franc mortgage litigation and related CJEU proceedings shaping EU-wide jurisprudence on consumer credit agreements, with disputes exceeding PLN 5 billion.
• Advising Bank Handlowy w Warszawie S.A., mBank S.A., BNP Paribas Bank Polska S.A., and the Polish Bank Association on precedent-setting consumer litigation challenging WIBOR-based loan agreements, including strategic guidance relating to the first Polish CJEU reference concerning WIBOR clauses.
• Advising EP Resources PL S.A. and other EPH Group entities on a series of complex cross-border post-acquisition disputes involving coal supply agreements, jurisdictional challenges, arbitration issues, and claims valued at approximately EUR 69 million.
• Advising Braindour Development Limited on a multi-jurisdictional post-transaction litigation and arbitration dispute arising from the sale of a Polish coal mine, including claims for repayment of a terminated EUR 54 million shareholder loan and related injunction proceedings.
• Advising Chubb European Group SE Branch in Poland in a precedent-setting insurance coverage dispute arising from the failed Ostrołęka C power plant project, involving claims exceeding PLN 500 million and significant ESG-related issues.
• Represented banks and other creditors in several bankruptcy proceedings in Poland.
• Advised a leading American private equity fund in a distressed restructuring of their investment in a Polish company operating in the oil industry.
• Acted for a Polish subsidiary of a leading German bank in the first group litigation in Poland concerning alleged improper modification of interest rates on mortgage loans denominated in Swiss francs during the financial crisis.
• Counseled a leading Polish bank in two group litigation cases concerning alleged irregularities in selling their financial products.
• Represented several Polish subsidiaries of international banks on potential liability arising out of the alleged mis-selling of currency derivative transactions to Polish exporters.
• Advised a leading U.S. insurance group and a leading German insurance group on several allegations of mismanagement related to currency and commodity derivative transactions worth EUR 150 million.
• Assisted a leading U.S. insurance group in a claim concerning the liability of directors and officers of a listed company for an alleged breach of disclosure obligations.
  
• Advised numerous leading international financial institutions in relation to BBB (Bankers Blanket Bond) claims concerning losses resulting from misconduct of bank employees, valued at EUR 50 million.
• Acted for a leading securities broker in Poland in a $16 million claim raised by a U.S. investment bank alleging malpractice in performing brokerage services.
• Counseled a financial arm of a large U.S. holding group in a $37 million claim raised against one of the Big Four audit firms related to professional malpractice in performing tax advisory services.
