Biography
Ursula Diale-Ali is a senior associate in Baker McKenzie's Tax Practice Group in Johannesburg. She advises multinational and domestic corporations on indirect tax, with a focus on customs, excise, international trade, and related value-added tax implications.
Her experience spans multiple industries enabling her to provide practical, risk-focused advice on compliance and strategy. She regularly assists clients with customs and overlapping transfer pricing audits, investigations, disputes, trade regulatory compliance, and supply chain structuring and support.
Representative Legal Matters
- Represented a South African company in the steel sector in an investigation conducted by the International Trade Administration Commission, into tariff protection, import surveillance, customs enforcement and policy driven trade remedies in that sector, with material indirect tax implications.
- Advised a retail group on the customs and trade implications of a complex transaction involving the acquisition of a large South African brand management and distribution business.
- Assisted a motorcycle manufacturer with a multijurisdictional customs and export control investigation focusing on its South African operations and franchise network.
- Assisting in advising a tobacco company in its challenge against the imposition of a tobacco levy imposed by the Botswana government.
- Advising a tobacco company on the duty to report and repercussions under South African excise laws, and coordinating a multijurisdictional survey on the same query across 8 (eight) other countries.
- Advised in matters challenging the imposition of anti-dumping duties in relation to disodium carbonate soda ash and motor vehicle windscreens.
- Advising multinational apparel and footwear corporation in a complex customs valuation dispute in South Africa.
- Advised various clients on trade regulatory compliance and license / permit registrations with various regulatory bodies.
- Advised a submarine telecommunication company in relation to arbitration proceedings outside of South Africa, relating to a dispute concerning fuel supplies to foreign-going ships and fuel levy refunds under South African legislation.
- Advised various clients on transfer pricing and customs valuation with regards to year-end adjustments.
- Advising various clients in relation to the regulation of electronic services supplies in South Africa.
- Advised various clients on the restructure of local and foreign investments.*
- Advised clients on various matters under the jurisdiction of the Master of the High Court in relation to trusts and estates, including estate-reporting, and trust-related work.*
- Assisted in advising client in relation to a deal structure for the importation of booster vaccines against SARS-CoV-2 into South Africa.
- Assisted and advised clients in relation to applications for tax exemption under the public benefit organization dispensation.*
