Biography

Ernesto Claeyssen is an associate in the Data and Cyber practice group based in our New York office. Prior to joining Baker McKenzie, Ernesto worked at another international law firm, advising clients on data privacy and cybersecurity compliance requirements and legal issues related to AI, and representing clients on matters related to commercial litigation, white-collar criminal defense, and product liability.

Practice Focus

As a Certified Information Privacy Professional (CIPP/US), Ernesto provides compliance-related advice on state and federal data privacy, cybersecurity, AI, ad-tech/social media and other data-related legal and regulatory issues, including the CCPA/CPRA, other state comprehensive privacy laws, Washington My Health My Data Act, BIPA, CAN-SPAM, HIPAA, GLBA, and the NYDFS Cybersecurity Regulation.

Ernesto assists clients with building effective data privacy and cybersecurity compliance programs and drafting or negotiating data privacy and information security provisions for commercial agreements, including data licensing, SaaS, MSA, and vendor agreements.

On transactional matters, Ernesto regularly counsels clients on data privacy and cybersecurity due diligence and integration planning in complex transactions, including mergers and acquisitions, divestitures, spin-off transactions, corporate sales and other related matters.
