Biography

Allen is a member of the Firm's North America Litigation and Government Enforcement Practice Group and resides in the Firm’s Dallas office. Allen has a proven track record of resolving complex and high-stakes commercial and employment disputes for clients around the country, including those based on breach of contract, antitrust and unfair competition, trade secrets, consumer protection, business torts, employment issues, and federal statutes. Before joining Baker McKenzie, Allen gained valuable insight into federal motion practice and procedure as a law clerk for the Honorable Jane J. Boyle of the US District Court for the Northern District of Texas in Dallas.

Allen graduated from the University of Texas at Austin and Texas A&M University School of Law, where he was a member of the Texas A&M Law Review and was awarded Order of the Coif for graduating in the top of his law school class. During law school, he externed with the US Department of Justice, Antitrust Division in Washington, D.C. and the US Court of Appeals for the Fifth Circuit. Allen is also a member of Baker McKenzie's cross-disciplinary Trade Secret Practice Group and frequently works with the Firm’s Antitrust & Competition Practice Group.

Practice Focus

Allen's practice involves representing clients across many industries in an array of commercial litigation and employment-related disputes in state and federal courts across the country and he has built a reputation as a battle-tested litigator capable of managing complex disputes in various jurisdictions. His experience includes litigating cases involving federal and state trade secret, antitrust and unfair competition, and racketeer influenced and corrupt organizations (RICO) claims, as well as complex contract disputes, business torts, and consumer claims on an individual and class basis. Allen also has experience consolidating actions through federal and state multidistrict litigation (MDL) procedures aimed at streamlining discovery and pre-trial proceedings. His practice encompasses nearly all aspects of litigation, and he regularly advises clients in all litigation phases, including providing advice on pre-suit investigations involving alleged workplace misconduct and crisis management.

Representative Legal Matters

  • Representing leading jobsite technology and equipment rental company in a series of more than 30 trade secret cases filed across the country. Helped to implement a strategy leading to consolidation into a federal MDL, as well as a related Texas MDL and other state coordination, and successfully obtained complete dismissal of several cases on summary judgment.
  • Representing large publicly traded energy company on multiple disputes arising from sales contracts for wind turbines and services contracts for the operation of wind farms.
  • Representing national retail crafts store in breach of contract and warranty disputes brought by and against vendors in state courts throughout the country.
  • Representing a national retail crafts store in confidential workplace employment investigations.
  • Representing portfolio companies of private equity sponsors in defending against trade secret theft and restrictive covenant claims in state and federal court.
  • Representing global leader of aluminum industry and market intelligence in action asserting copyright infringement and breach of contract claims against former subscribers.
  • Representing multinational technology company in sublease termination dispute that was favorably resolved prior to filing suit.
  • Representing national poultry producer in breach of contract and negligence action jury trial. Jury awarded breach of contract counterclaim damages to client and rejected Plaintiff's claim for over USD 20 million in punitive damages.
  • Representing private drilling and exploration company in numerous onshore and offshore personal injury and wrongful-death claims in state and federal courts in Texas, New Mexico, and Oklahoma. Routinely investigated claims from date of incident, address indemnity and defense issues, and prepare cases for favorable resolution at trial or mediation.
  • Representing medical-device consulting firm on pre-suit partnership dispute and dissolution.
  • Representing multinational consumer products manufacturer in confidential workplace employment investigations.
  • Representing major real estate broker in pre-suit partnership dispute and dissolution.
