Jonathan Tam, a partner in Baker McKenzie's Commercial Practice Group, was quoted in a recent Vanity Fair article that follows a serial entrepreneur, whose AI agent, "Olive," handles many aspects of his daily life, from responding to emails and booking travel to assisting with business operations.

Jonathan noted that existing legal frameworks have yet to fully address disputes arising from autonomous AI agents. While legal cases involving AI agents remain limited, he noted that regulators are beginning to clarify accountability, pointing to a new California law that prevents developers from arguing that an AI system itself is responsible for harm caused in civil matters.

The article highlights a range of potential scenarios that could raise legal concerns, including AI agents making unauthorized transactions, causing financial losses, or taking actions that produce unintended consequences. As organizations and consumers increasingly experiment with agentic AI technologies, questions surrounding responsibility, governance and risk allocation are expected to become more prominent.
