Baker McKenzie partner Adam Aft was quoted in Lexology on the potential federal moratorium in the US prohibiting states from enforcing AI-specific laws, and what such a moratorium would mean in practice.

Adam noted that if the anticipated moratorium is limited to states’ AI-specific laws and regulations, it may be a welcome pause in enforcement. Though he noted that such a moratorium would not render the US as “the Wild West devoid of any AI legal risks.” Many other state-level laws would still be applicable in cases of alleged harm, he said. Moreover, multinationals will continue to be held to the standards of other jurisdictions' AI laws, including, for example, the EU AI Act.
