Baker McKenzie lawyers, Michelle Heisner, Andrii Moskalyk and Yanshu Zhang, recently co-authored a piece in Reuters titled, “Breaking Ground: US-Ukraine Mineral Deal Ratified in Ukraine, Paving the Way for Reconstruction.”

As a means to revive its economy and bolster national security, Ukraine has signed a landmark mineral deal with the United States. The agreement aims to strengthen the relationship between the two countries by aligning economic interests. Although the draft text of the limited partnership agreement between representative agencies of the two countries has not been officially disclosed, the authors anticipate its completion in the coming months.

Through the agreement, Ukraine hopes to see substantial investment in infrastructure and development, but uncertainties around private sector involvement as well as the partnership fund's governance structure, source of startup capital, and licensing rights, remain. In the article, the authors explore these critical, but unresolved, issues and the ways in which they may affect the deal's implementation and benefits. The ultimate success of the framework agreement has broad consequences; as the authors point out, "[it] could shape the future of both nations and set a precedent for global reconstruction efforts."
