1. Data controller

Pursuant to EU Regulation 2016/679 of the European Parliament and the Council, dated 27 April 2016 on the protection of natural persons with regard to the processing of personal data and rules relating to the free movement of personal data (hereinafter, the “GDPR”), you are hereby informed that BAKER & MCKENZIE BARCELONA, S.L.P., with registered offices in Barcelona, at Avenida Diagonal 652, Edif. D, 8ª Planta, and holding Corporate Tax ID no. B- 61.181.145 (hereinafter, "Baker McKenzie") will be processing your personal data in its capacity as data controller.

2. Purpose and legal grounds of the processing

Prior to the collection of the personal data, Baker McKenzie will provide information to the data subjects about the purposes and legal basis in connection with the relevant processing activity, as wells as the rights of the data subjects. The general purposes for which Baker McKenzie will process the personal data of the data subjects are the following: (i) to send information of interest to you, including invitations to events that are organised by Baker McKenzie, on the legal basis of your consent; and (ii) to maintain our commercial relationship with you, if such be the case. To such end, the legal grounds for processing your data will be the relevant service agreement that is executed.

3. Data Retention Period

Baker McKenzie will process your personal data as long as you do not express your wish to the contrary by exercising your right to object or by revoking your consent to receive communications. In such a case, we will proceed to block your personal data, which will be kept exclusively for a period of three years from the date of the request.

This retention period will have the sole purpose of the formulation, exercise, or defense of potential claims, as well as compliance with any applicable legal obligations.

4. Recipients of Your Data

Your data may be shared with third-party service providers acting as data processors for Baker McKenzie companies. In addition to the foregoing, Baker McKenzie may carry out transfers or communications of personal data to fulfill its obligations to Public Administrations in cases where required by the legislation in force at any given time, and where applicable, also to other bodies such as State Security Forces and Corps and Judicial bodies.

Additionally, we inform you that your data may be transferred to countries located outside the European Economic Area, where Baker & McKenzie International has offices, which are identified on the Baker McKenzie website. In these cases, the transfers are based on standard contractual clauses approved by the European Commission.

5. Rights

Baker McKenzie informs you that you have the right to freely exercise your rights of access, rectification, opposition, erasure, portability, and restriction of processing, as well as to object to automated processing, of your personal data by sending an email to the following address: dpo.spain@bakermckenzie.com.

You have the right to object to the processing of your data for the receipt of informational communications by simply notifying Baker McKenzie of your wish to do so. To this end, you may send your request using the procedure described in the previous paragraph. Likewise, you may cancel the receipt of informational communications in the manner provided in each commercial communication (for example, through the link included in each of them).

In addition to the aforementioned rights, you may withdraw the consent granted at any time through the procedure described above, without said withdrawal of consent affecting the lawfulness of the processing prior to its withdrawal. Baker McKenzie may continue to process your data to the extent permitted by applicable law.

We remind you that if you believe that we have not correctly addressed your request, you may file any complaint you deem appropriate regarding the processing of your data with the Spanish Data Protection Agency (Agencia Española de Protección de Datos) (https://www.aepd.es/).

6. Amendment of this policy

Baker McKenzie may amend its Privacy Policy in accordance with applicable law at all times. In any case, we will inform you of any change in our Privacy Policy that could have a material impact on your privacy and data protection. If this is required by applicable regulations, we will provide you with the opportunity to reissue your consent.
