The public consultation opened by the Brazilian Data Protection Agency (ANPD) on the Digital Child and Adolescent Statute (Law No. 15,211/2025 – “ECA Digital”) ends on 12 December 2025.

ANPD’s public consultation is based on a Technical Note issued by Agency that describes the definitions and terms referred to in ECA Digital. Even though the regulations are expected to be more comprehensive, ANPD published only one very broad and open-ended question: “What are the main definitions, terms and expressions set forth in ECA Digital that require further clarifications for its full understanding and for the application of the law? Which parameters could be considered to make each of those definitions, terms and expressions more precise?”

Given that ECA Digital introduced significant structural changes, and many of its provisions are challenging to implement and interpret, the public consultation is a good opportunity to provide relevant inputs for the Agency. All contributions are public. ECA Digital will enter into force on 17 March 2026 and regulations are expected to be published prior to the entry into force of the law.
