In brief
The TCCT’s new credit terms notification, effective 2 November 2026, strengthens SME protections against unfair payment practices and clarifies that restricted contractual provisions apply only to credit terms.
In more detail
The Trade Competition Commission of Thailand (TCCT) has issued a notification on credit terms between large business operators or large modern trade operators and small and medium-sized enterprises (SMEs), which will come into effect on 2 November 2026.
The Notification on credit terms between large business operators or large modern trade operators and small and medium-sized enterprises (SMEs) was published in the Royal Gazette on 2 October 2026 and will take effect on 2 November 2026. The draft of this guideline was published for comments earlier in August – for more details on the notification, please see our previous client alert.
The final guideline is largely similar to the draft published for comments. One substantial change is the clarification that the non-permitted (unless justified) standard contractual provisions subject to the guideline include only provisions relating to credit terms.
The new guideline aims to strengthen protections for SMEs in relation to credit terms in transactions with large business operators, including large modern trade operators, and to address ongoing concerns and complaints submitted to the TCCT regarding delayed payments.
